He was in his 86th year, Born in Belmnore, he taught school in Lower Wingham for a short period before entering the ministry. He' served at .chilbehes' its Blyth, Delaware, Sandwich South, Shelbourne, Windsor and Jc icarrdine, efore going to Dur- hani where he was made an arch- deacon in 1940. He retired in 1940. (Gleno Hays told the court that the accident occurred•when the ac- cused made a "elft turn off the highway wittiest giving a Sig-, nal. Anot�her ear going in the same dineetion, was attempting to pass and smashed into th,e Caldwell car. The accused told the !magis- trate (that he felt it was a "no passing" area since there was a double unbroken line on the highway. "There's no ruling in the Highway Traffic Act covering that," the magistrate told him, "but there is a ruling Ith,at a signal must be given for a left turn." The airman was given a min- imumfine of $5 and costs. SIGNAL. CAUSES DOUBT; DRIVER IS ACQUITTED Doubt over what type of signal was given 'by a -driver figured strongly in dismissal. of a careless driving charge against another driver in court here last Thursday. William John Elliott, Elizabeth street, was charged folllowing an accident on May 14 at the inter- section of West and Waterloo streets. • Thys Groen, R.R. 4, Goderich, told the court that ^he was driving a car ahead of 'Elliott's car' on West street and signalled that he' intended to turn right onto Wel- lington• street. As he made the turn, he said, the car (behind hit his vehicle on the right side. A witness to the accident, Cor- nelius Van den Reuvel, R.R. 2, Goderich, said he was sitting in his parked car on West street mid- way 'between Waterloo and Wel- lington streets. He saw the two cars pass, he said, and his atten- tion was drawn when he noticed the Elliott car gain in speed. He did not notice if the driver of the lead car 'had given a signal. !Constable Dona•ld.`Hobbs, of the Goderieh • Police Department, said that skid marks made by the El- liott car were 57 and 61 feet in length. There was evidence the accused had been drinking, but he 'was not impaired, the constable testified. • Elliott, in his own •defence, maintained that Groen had given a signal for a left turn. Since there was a car approaching from the opposite direction, he felt the lead car was going to stop, so proceed- ed to pass on the right, 'Elliott said. Magistrate D, E. Holmes, in his. decision,, said that outcome of the case hinged on the signal. ' To register a conviction, he said, there _would have had to have been cor- roborative evidence that Groen had signalled for a right turn.
