WEEREAS a -majority in number of the
owners, as thown by the last revised Ati-
sessment Boll of the property hereinafter
, 'set for th to be! drained (whetner lots 18,14,
15 and 1( nt the,22nd concession be or be
not added ther‘ao and included therein)
have petitioned the Council of said Town-
ship of Stephen preying that the west half
of 14 three and lots 'cur to nineteen (both
• inclusiye) in Aux Stableconcession, and
lots six to twelve (both inclusive) and
seventcen to nineteen (hoth inclusive) in
22nd eoneetsion--all forming one block of
land -in said township, should be drained,
and that fui Enginesr should be .procured
to make no examination of the locality and
plane and estimates of the necesssary work
and an assessment of the property to be
benefitted (whether for direct benefit, out-
let or otherwise) thereby.
AND 'WHEREAS thereupon the said
Council iMocuied an examination to be
made by Richard Coad,1,. L. S., and En-
gineer, being a person competent for such
purpose, of tho locality proposed to be
drained. and has also pi oeured plans and
estimates of the work to be made by the
said Richard Coad, and an assessment to
be made by him of the real property to be
benefitted by such drainage, stating as
nearly as he can the proportion of benefit
which in Ilia opintou will be deriyed in
consequence of such drainage by every road.

xitenteof the lands and roads in Stephen so
Insole, being the !assessment hereinafter
by this By-law enacted to be assessed and
levied upon the lots and parts of lots and
roads nerein after in that behalf. specially
set forth and described :-
.A.ND WHEREAS the said Richard Coed
found and leported that lots 13, 14, 15 and
16 in the 22nd concession of Stephen
Township adjoining attid block of land will
also be benefitted, and that lands in the
adjoining Township of Bosanquet (des-
cribed in a petition to the said Council by
-a majority of the owners thereof for the
drainage works now ptoposed) will also be
benefitted, and that the proposed:work will
-form an otatlet for watere from the other
'adjoining Towilahips of McGillivray and
West *Williams, and that the lands and
roads in said seven at Townships may be ae-
seesed and Charged under the provisions of
Sections 575, 576, 590 and other Sections
of the ktnnicipal Act ; and the assessment
upon the lands and roads in said several
adjoining Townships are :hereinafter set
forth in the Report of said Richard' Coed
in respect of said 'work and drainage, which
report is as follows

able, end to afford more rapid diScherge of
water during times of freshet, and to girl) the
greatest possible depth of. drainige at all
times, I recommend the bottom Of the cut to
be tote foot lower than -the surtace of the wat-
er in the lake at the thug, of irtepeetion The
greatest depth of miffing will he IR feet 8 in.,
and the shallowest in the out 12 ft 8 in, or an
Average of about 20 feet for 80 rode. The bot -
tout width of the out and work in the river up
to Rayeoele Creek will be 30 feet and from

The bed of the river from the head of the
Cut is very irreguier as shown on the motile
for aistames up stream of about 1 and three
eighth miles, the water varying in depth from
1 foot to 8 feet, Above this. the bed is more
regular and the w a or from 5 to 6feet deep to
stake 29t) at the mouth of Haycock Oreek., The
creek it :shallow and not so irregular.
The bottom of the cut and work in the:river
when completed will be level throughont the
whole distance of the proposed diem in the
river so as to give as notch fall as possible to
the waters of ilayeeek Creek and the water
front the river above. The depth of the *irk
when completed in the river at the mouth of
hint -cock ()reek will be 8 feet 7 inches below
the surface of the ground and will be level
wita the bottom of the proposed drain in IlaY•
e,oek creek, which latter draM front its head
will have a fell et 6 feet? inches and at ,i.s
head the proposed drain will be dug 4 fOOD 3
inches betew the surface of the ground, and
the fall or incline in the bottom will be uni-
form throughout its length ; and as the river
above when the work itt it leaves otf is 7 or
more feet deep for 4 miles or more. 'We may in-

the inspection was made the surface of the
water in the river t•hroughout this part will
stand practically on a level -with. the water in
the lake, or about 5 feet 7 inches lower than it
did last fall..
For some distanee below the entrenee of the
Ptsebe River (a.watereouree not navigable) at
what is know as the "Elbow" the channel is
somewhat filled with a loose deposit, carried
down by the Ptsebe, leaving it only about 3
feet deep in places, but 1 ani of oinnio u that
when the work is completed this loose deposit
will be carried further down and left in the
deeper partsthus affording a good outlet and •
deeper driiihage for the waters from the lands
further up the Aux.Sauble as well as the Ptsebe

*received from your Hon mable Body through
the Clerk ot your illuniCi pality and a Resolu-
tion of Council. dated 26th 1Viy, 1853, and in
accordance with a PaiiiiOn signed by John
Dalziel, Philip taker, E. 3. Spackman and
others, 'Praking for the draining of certain
lands (described) in the Aux Sauble and Twen-
ty -Second Os:Messier' of your tormsbip.
I have made an examination of the said lo-
cality proposed to be drained and of the lands
and road § that willbe affected by the construe
tion of such drainage works as will be neces-
sary to dmin the same and to relieve the desert
lied locality in your township from the waters
coming upon them from the higher lands, and
I hevemade the accentuating plans (including
profiles) specifications and estimates of tile
work Ipeasose to do to drain said locality,and
I have made an assessment (appended hereto)
of the said described locatity in so far as the
ancisand roads comprised therein are to be
benefitted and improved, and of ;other adjoin-
ing lots, namely Lo ts 33,14,15 and 16 in the
'22ed concession, which ale° in MY opinion will
be benefitted ; and as the necessary work to
• drain said locality in Stephen, will also in ray
opinion benefit lands in the Township of Bee-
anquet(heing the lands in said Townehip 'par-
ticularly described in said -petition and the
petition of. the Canada. Company) end improve
Toads therein I have charged the same with a
yust proportion of the cost of the proposed
:work : end as the said work Will further be
an outlet for portions of the Townships of
Bosenquet, McGillivray and Williams and the
lands therein. end will be necessary to carry
off the water caused. to flow therefrom to or
upon the said. locality in Stephen. I have as-
eessed and charged said Townships and the
lands 'therein for a just proportion of the con-
struction of such work, al of which assets-
raents are impended crate.
In so opinion the locality described. in
Stephen Totynehip can be most effectually,
• (knitted by constructing a drain in Haycock
creek about 88 rode:and carrying tbe water into
the water -course called Aux Sauble River (but
not tnevtgebia) a.nd tbence along that course
Eneterly to the Grand Bend and thence across
t/th bar into Lake Huron.

The bank along the lake shore through which
the cut is to be made is composed chiefly o
lake shore sandt and the chant el will no doub
widen to a oomfortable extent by the action of
the water.from the river tie time -goes on. It
may also be found that the action of the lake
during times of storm from the, west may
have the effect of somewhat obstructing the
mouth of the cut by casting up loose sand. kke.
Especially wilt this be the ease when there is
not much water flowing in the river, and at
such times the effect will not be injurious.
This oliatruetien I am of opinion, however.
will be cerried away again at tames of higher
water in the river, end the channet will be
kept open pretty generally to the depth eon.

outlet for the waters before referred to, and lie
the Inee,ns of reclaiming lands that have here-
tofore not been made use of, and rendering
them fit for cultivation.
The earth gemoved from the cut may be dis-
posed of by casting it into the lake at is suit-
able distance to be determined by the engineer
of your township, by casting it oyer the bank
of the lake not closer than 10 rods to then:tooth
of the cut, or by putting part of it into the
river channel below the cut. and by depositing
it in the channels or low places intersected by
the cut, on the surface of the ground on each '
side and not closer than 8rods to the e.dge of
the cut tinder the direction of such engineer.
The amount to be deposited et each piece to be
determined by the engineer overseeing the
work for your township.
The earth removed in dredging the channel
of the river May be deposited oti either or bath
sidea of the river as directed by such engineer
from time to time --not closer than 8 feet to
the edre of the present channel.. The eerth
removed from the drain in Haycock Creek
shall be deposited evenly on each side of the
drain at a distance of at least 5 feet front the
outer edges of the proposed work,- All stumps
roots, logs, boulders or other obstructions must
be cut and removed, from tbe channel to a suf-
ficient distance from it. Slope stakes will be
set mid levels of the height of water. ,fi.t. wilt
be given the contrite tor at the tune of com-
mencing the troth by the engineer as appears
in'the profiles and this report.
In the assessment the higher and outlying
lands are assessed least, while those closer 80
the work and lower, being most benefitted, are
assessed most. All the land .e including those
lenefitted end those assessed for outlet are
those shown on the plan in areen. The green
dotted line glows the limit of assessable lends
appioximately. On the west side of tbo river
said line is comparatively close aS the high
land is not far back in the Lake Road East
concession, and it concession '.B" there is a
dry gravelly ridgeabout 4 feet high, wnich
follows the direction of the rii-cr =Ms lots
1 to 10,whieli forms the watershed between it
and Lake Smith.' South of this the land is ,
very level id there is no very perceptahle
watershed between the river and lake Smith
end Burwell Which are drained by brae
drains constructed by the Canada Compeny.
I have therefore considered that it will be
about midway between them.
Asoneof the large drains referred, to and
known as the Canada Company Canal (40 feet
wide in the bottom) taps the river and relieves
it of the greater part of its water a: the line
betv een Lots 20 and 22 in conoesssion "A" of
the towtiship of Bosanquet I have therefore
assessed only as far as the linebetween lots 10
and 20 on coneession".a." of the towitship of
Boseinquet. There int several creeks in the
towns/lips of Stephen and McGillivray into
which waters are brought, end having low
marshy flats of considerable width on each
sji3ii and 1 have assessett for eaine, distance
Of the lands to he benefitted and those as-
Pessed for outlet_ (not including road
antics) there are 8111 mires. The assessment
Per were varying from 39e to 84,15, or an aver-
age of about 62.52 per. ttere. Of this there
are in the_township of Stephen 2357 acres at an
average of about 842 621 per acre ; in the town-
ship of McGillivray 3034. acres at an average of
:ibout $2.561 per -acre ; in the tt wnship of Bo-
san quet 1707 acres at, an average of about $2,-
411 per acre, and in the townthip of West
Wilisims where the low Ptscbe River and
creek 1.00 up into it, ee, acres at an average of'
850 per acre. The minis assessed and .charged
will be greatly improved by the proposedwork.
