OF 1888.
4 By. Law to provide for draining
• part of the Township of Stephen,
• and for raising on the credit of the
unicipolity, $5,505, for complet-
ing the worhs ?feces sary therefor.
ProvIsionally adopted, the Oth tido
of at/come, 1888.
WHEREAS a majority in number of the
owners, as ehown by the last revised As-
serement Roll of the property hereinafter
eat forth to be drained (wbettier lots 18, 11,
15 end 16 in the 22nd, concession be or be
not added thereto end ioolecled therein)
have petitioned the COlincil of said Town-
ship of Stephen praying that the west half
of lot three and lots fc or to niueteen (both
inalusiye) in Aux Saeble coneession, and
lots six to twelve (both inolusive) and
seyentk en to nineteen (both nelusive) ia
22nd coneession--all forniing oue block of
land -in said township, should be drained,
and that au Engineer .etrould be procured
to make an examination of the locality and
plane and estimates of i,he necessary work
and an assessment of the property to be
benefitted (whether for direct benefit, out-
let or otherwise) thereby.
AND WHEREAS •thereupon the said
Council prooured an examination to be
made by Riobard goad, P. L. 'S., and En-
gineer, being a person competent for such
purpose, of the locality proposed to be
drained, and has also procured plans and
estimates of the work to be made by the
said Richard Coed, and an assessment to
be made by him of the real property to be
benefitted by such drainage, stating as
nearly as he can the proportion of benefit
which in hie °pinto!) will be derived in
consequence of such drainage by every road
and lot or portion of lot, the said. asses-
ment of the lands and loads in Stepheu so
made, being the :assessment hereinafter
by this By-law enaoted to be assessed and
levied upon the lots and parts of lots and
rondo nereinafter in that behalfspecially
set forth and described :--
AND WHEREAS the said Richard Coad
found and reported that lots 13, 14, 15 and
16 in the 22nd concession of 8tephen
Township adjoining said block of land will
also be benefitted, and that lands in the
adjoining Township of Bosanquet (des-
cribed in a petition to the said Council by
a majority of the owners thereof for the
drainage works now proposed) will also be
benefitted. and that the proposed:work will
form an outlet for waters from the other
adjoining Townships of McGillivray and
West William, and that the lands and
roads in said several Townships may be as-
sessed and charged under the provisions of
Sections 575, 576, 590 and other Sections
of the Municipal Act ; and the assessment
upon the lands and. roads in said several
adjoining Townships are :hereinafter set
forth in the Report of said Richard Coad
in respect of said work and drainage, which
report is as follows :-

To the Municipal Council of the Town-
ship of Stephen -in Session A ssem-
bled :-
GEstrantzx :-In obedience to instructions
received from your Hotemable Body through
the Clerk ot your Municipality and a Resolu-
tion of Council, dated 26th May, 1668, and in
accordance with a petition signed by John
Dalziel, Philip Baker, E. J. Spackman and
others, praying for the draining of certain
lands (described) in the Aux Sauble and Twen-
ty -Second Csneession of your township.
I have made an examination of the Said lo-
cality proposed to be drained and of the lands
and roads that Will he affected. by the construe
tion of such drainage works as Will be neces-
sary to drain the same and to relieve the desori
bed locality in your township from the waters
coming upon them from the higher lands, and
I have made the accommtning plans (including
profiles) specifications and estimates of ;the
work Ipropose to do to dram saidlocality And
1 have made an assessment (appended hereto)
of the said described locality in so far as the
lands and roads comprised therein are to be
benefitted and improved, and of .other adjoin-
ing Iots. namely : LotslB,14,15 and 16 in the
22nd concession, which also in my opinion will
be benefitted ; and as the necessary work to
draM said locality in Stephen, will also in my
opinion benefit lande in the Township of Bos -
aliquot (being the lands M said Township par-
ticularly described in said petition and the
petition of the Canada Company) and improve
Toads therein I have charged the same with a
just proportion of the cost of the proposed
work: end as the said work will further be
an outlet for portions of the Totenships of
Bosanquet, McGillivray and Williams and the
lands therein, and will be necessary to carry
off the water caused to flow therefrom to or
upon the said Tocelity in !Stephen. I have as-
sessed and charged said Townships and the
lands therein for a just proportion of the con-
struction of such work, all of which assess -
meats are appended hereto.
Th my opinion the locality described in
Stephen Township can be most effectually
drained by constructing a drain in haycock
creek about 88 rods:and carrying the water into
the water -course called Aux Sauble River (but
not navigablo) and thence along that course
Easterly to the Greed Mend and thence across
the bar into Lake Huron.
I found that th e surface of the water in Lake
Huron was five feet, seven inches lower than
the surface :of the water in the river at the
Grand Bend fthe river being at its lowest at
time of inspection) sand that for the next 11
miles there was a rise in the surface of the
water up the river of about 2:1- inches -above
this the surfoce was practically levell for the
next three miles or more. The present outlet
of this water is by the natural course of the
river to about twelve miles south. This Chan-
nel is shallow and the stream sluggish, and
does not form an efficient outlet for the waters
referred to and the lands in Stephen proposed4to
be drained; and I am of opinion that the best
means of providing such an outlet would be by
the construction of the drain and work herein
recommended.
I have xna,cle all necessary surveys and have
Wean levels,. The proposed drain and work
will begin le Stephen Township at a Point
marked"A" in lot No.10, in the Aux Salable
Concession, at about 21 'rods Southerly front
the lino between Lots Number 9, and 10, and
about 76 rods Easterly from the rivet' measur-
ed along said line and will follow frem there
the general course of the present water rue
•ealledIfaycock creek and will run into and
along said Aux Sauble River to the Grand
Bond. and thereafter into Bosangnet Town -
Ship and across the liar or height in lot One to
an outlet into Lake Huron. ,

the Bond of the River and the Lake leaves the
river at a point about 66 rods Westerly from

stakes from the lake to the river, and depths
or the present water courses were taken ,up

cook Creek, and from these depths and levels
was prepared the accompanying profile which
shows the (teeth at each stake and at the var-
ious other stations ma, -ked en the proAle, and
other dimensions to which it is proposed to
make the out andrematuder of the work con -

A s the height of the loke is somewhat vari-
able, and to afford more rapid discharge of
water during times,ef freshet, aud to give the
greatest possible depth of drainrge at all
times, I recommend the bottom of the cut Mr
be one foot lower than the eurteee of the wat-
er in the lake at the time of inspection. The
greatest depth of cutting will be 31 feet 9 in.,
and the shallowest in the out 12118 in, or an
average of shout 20 teat for 80 rods. The bot-
tom width of the out and work in the river up
to Haycock Creek will be 30 feet aud from
thereon to 5 feet up the creek to the hood of
the drain. The side slopes • of the cet and
along the river shall be one and one half hori.

The bed of the river from the head of the
cut is very irregular as shown on the profile
for a discauee up stream of about 1 and throe
eighth miles, the wt ter varying in depth from
11006 to 8 feet, Above this the bed is more
regular ond the water from 3 to erect deep to
stake 290 at the mouth of Haycook Creek, Tho
°reek is shallow mid not so irregular.

when completed will be level throughout the
whole distance of the proposed dram in the
rivers° as to give as much fall as possible to
the waters of Haycock ()reek and the water
from the river above. The depth of the work
when completed in the river at the mouth of
Haycock Creek will be 6 feet 7 inches below
the serfage of the grotilid and will be level
with the bottom of the proposed dramisa Hay-
cock creek, which latter drain from its head
wilt have a fall of 6 feet 7 inches and at i s
head the proposed. drain will be dug 4 feet 3
Welles below the surface of the ground, and
the fall or incline in thehottom will be uni-
form throughout its length ; and as the river
above when the work in it leaves off is 7 o r
more feet deep for 4 miles or more. we may in-
fer that under similar circumstances to when
the inopeotion was made the surfaoe of the
water in the river throughout this port will
stand practically on a level with the water in
the lake, or about 5 feet 7 inches lower than it
did lest fall.
For some distanee below the entrance of the
Ptsehe River (a watercourse not navigable) at
what is know as the "Elbow" the channel is
Somewhat iitled with a Mese deposit, carried
down by the Ptsebe, leaving it only about 3
feet deep in places, but 1 ani of opinion that
when the work is completed. this loose deposit
will be carried further down and left ' in the
deeper parts -thus affording a good outlet and
deeper drainage for the waters from the la nds
further up the Aux Sauble as well as thePtsebe
Rivers.
The bank along the lake shore through which
the out is to be made is composed chiefly of
lake shore sand: and the channel will no doubt
widen to a comfortable extent by the action of
the water from the river as time goes on. It
may also be found that the action of the lake
during times of storm from the west maY
have the effect of somewhat obstructing the
mouth of the cat by casting up loose sand, Oto.
Especially will this be the ease when there is
not much water flowing in the river, andat
such times the effect will not be injurious.
This obstruction I am of opinion, however,
will be carried away again at times of higher
water in the river, and the channel will be
kept open pretty generally to the depth con-
structed, and thus afford a quick and efficient
outlet for the waters before referred to, and be
the means of reclaiming lands that have here-
tofore not been made use of, and rendering
them fit for cultivation.
The earth gemoved from the cut may be dis-
posed of by casting it into the lake at a suit-
able distance to be deterrainedby the engineer
of your tovvnohip, by casting it otter the bank
of the lake not closer than 10 rods to the mouth
of the eut, or by putting part o' it into the
river channel below the cut, and by depositing
it in the channels or low places intersected by
the cut, on the surface of the ground on each
side and not closer than 3 rods to the edge of
the cut under the direction of such engineer,
The amount to be deposited at each place to be
determined by the engineer overseeing the
work for your township.
The earth removed in dredging the channel
of the river may be deposited on either or both
sides of the river as directed by such engineer
from time to time --not closer thou • 8 feet to
the edge of the present channel. The earth
removed from the drain in Haycock Creek
shall be deposited evenly on each side of the
drain at a distance of at least 5 feet from the
outer edges of the proposed work. All stumps
roots, logs, boulders or other obstructions must
be cut and removed from the channel to a suf-
ficient distance from it. Slope stakes will be
set and levels of the height of water. &e. will
be given the contraetor at the time of com-
mencing theivork by the engineer as appears
in the profiles and this report.
In the assessment the higher and outlying
lands aro assessed least, while those closer to
the work and lower, being most benefitted, are
assessed most. 111 the lands incleding those
benefitted and those assessed for outlet are
those shown on the plan in green, The green
dotted line shows the limit of assessable lands
approximately. On thewest side of the river
said line is comparatively close as the high
land is not far back in the Lake Road East
concession, and in concession ''B" there is Elk
dry gravelly ridge about 4 feet high, wnich
follows the direction of the river across lots
1 to 10,which forms the wateralied between it
omd Lake Smith. South of this the land is
very level and there is no very perceptable
watershed between the river and lake Smith
and Burwell, which are drained by large
drains constructed by the Canada Company.
I have therefore considered that it will be
about midway between them.
As oiled the large drains referred to and
known as the Canada Company Canal (40 feet
wide in the bottom) taps the river and relieves
it of the greater part of its water ar, the line
between Lots 20 and 22 in conoesssion "A" of
the township of Bosanquet I have therefore
assessed only as far as the line between lots 19
and 2000 concession "A" of the township of
13osanquet. There are several creeks ir3 the
townsnips of Steph,en and McGillivray into
which waters are brought, and having low
marshy fiats of considerable width on each
side and 1 have assessed for some distance
up these. '
Of the lands to be benefitted and those as-
sessed for outlet Mot including. 'road allow-
ances) there are 8114 acres. The assessment
per acre varying from 80e to $4.15, or an aver-
age of about $2.52 per ;tem. Of this there
are in the township of Stephen 23,57 acres at an
average of about 92.621 per acre ;in the town-
ship of McGillivray 3934 acres at an average of
about $2.561 per acre ; in the township of Bo-
sanqu et 1797 acres at an average of about S2-
411 per acre, and in the township of West
Williams Where the low Pthebe River and
Creek run up into it, 26 acres at an average of
85c per acre. The roads assessed and charged
will be greatly improveclby the proposed work.

shall after the completion thereof bepreserv-
e el, maintained and kept in repairby the mu-
nicipality of Stephen down to where it enters
and is carri ed into Bosom clue t , an d from that
point to the lake by BosanqueS, at the expenee
of the lots and roads charged and assessed
in Stepl3en, Bosancinet mcGilivray and West
Williams for the original construction there-
of, and in the relative proportion of such
charge land assessment -each municipality
contributing the aggrega te amount of the
mine chargeable against ilandain [and roads
of or under the control of that municipality,
and each municipality paying:out of the
moneys raised from the 'whole 4a.teable prop-
erty,the amount 'chargeable to roads in that
municipality.
8. Thatthe municipal corporation of the
township of Stephen shall let the contracts
to independent contractors for said prop oseti
works as specilled in the reports., plans [in-
cluding profiles, and speeiticattoxis adopted
hereby to the lowest bidder (not exceeding,
Mao estimates); and each contrector shall
furnish ot least one satisfactory surety for
the careful, proper and complete performance
[of said -work as epeeifietu not tater than the
lOirtt 1/ay of Decomber,1869, unless otherwise
ordered by the Council of Stephen, a n d that
Bichard Coad is appointed to examine said
work during c onstructio e whenever request-
ed by the munieipalcorporation of the town.
