An interesting horse case was settled here
by arbitration, on Saturday lest. Some
time ago Mr. Rerniolt of Usborne purchased
of Mr. Priecadore of Stephen a brood mar,e,
paying 8160 for her. At the time the pur.
chase was made the beast was( thoroughly
examined by Mr. Remick end another gen.
tlernan. Mr. Priscaclore told them thtvt the
beast was slightly lame bat if kept peopee.
ly shod it would never be notreed. The an.
irnal was purchased by Mr, Kerniek, he giv-
ing his note for $160. After keeping the
beast for some timeginding that she did not
turn out as was expected, he desired Mr.
Priscadore to either take the animal back or
reduce the price for which he had given his
note. This Mr, Priscadore refused to do
claiming that the sale had been made on a
fear basis ; and in fact he did, not want to
dispose of the animal at all. Mr. Remick
then set eboat to sue for damages on the
plee, that the animal had been misrepresent -

James 13allantyne a third man, and the law!'
yers together with a host of witnesses as.
sembled at the town hall. Friday, andSat.
urday until 10 o'clock p. in. was spent in
hearing evidence. Mr. Remick attested
that the beast was very lame, as also waa a
suckling and held that there was something
wrong with the mare whish affected the
colt. The testimony of several veterinary
men was heard and nearly all disagreed as
to the animal's ailment, some rdituning it
contraction of one of the feet, others that
she was sweenied. Mr. Priscadore and ot-
hers said that the beast -was seldom lame
and that, as had been told Mr. 3Iernick, if
she were kept properly slaod, the larneuese
would not be discernable ; that Mr. Prisca-
dore as not anxious to sell the beast; and
that Mr. Remick was bound to have her.
The arbitrators found for Mr. Priscadore on
the ground that he had acknowledged pre-
vious to sale that the animal -was lame ; and
that as he was not caring to sell there was
no wilful misrepresentation on his part.
