When Bob and t were married
we drew up a contract to cover
*hat would happen if we ever
split up. It covered things like
who got what property, who
got custody of the children,
and what sort of payments I
would be entitled to.
Is this a valid contract?
Except possibly with respect
to the division of property. the
contract is of no legal effect at
all Essentially what you have
done is entered into a
cepa ration agreement while
y„u are still living together.
Our iavt considers such
contracts invalid because they
are ontrary to the nature of
marriage
You certainly could not force
the court to give custody of a
h i Id t o one or another parent
an tract in any event.
The courts must decide
..,tody cases in the best in-
terests of the child.

My Mother orde ed a cotou
TV at an applian ore in
Toronto, but the set was never
delivered. and when she went
back to the store it was closed!
She signed three promissory
notes for .$90 each. The notes
were sold to a finance com-
pany. and now they wants
to pay the first one. Does she
have to pay?
The Bills of Exchange Act was
amended in 1970 to require.
that every promissory note
tssuefi to finance a consumer
purchase be marked "conn
sumer purchase" It was
made a criminal offence
knowingly to issue or receive a
consumer note without such
marking.
If your note was marked
'consumer purchase you
have the same rights against
•he finance company as; you
would have against the ven-
dor. ie you do not have to pay
unless you get the goods.
