Game Overseer Harold Cautelon, of
\Wingham, charged that the men were
hunting, deer 'in a, bush near Belfast
ou Novviber 12th. He testified that
he had seen tw•b deer, a fawn and a
buck, running iu an excited manner at
full speed, , and later a doe, followed
by' a dug. - He saw a car parked ou
the side of the road, and Thibault with
a .22 -calibre Winchester rifle. He told
Thibault to wait and while he went
to a truck 'both man and gun disap-
peared. Finally all' the men came to
the car. The overseer said he had
heard baying in 'imitation of Hounds.
He had • summoned Overseer Kenneth
1 ucl: and Provincial ('unstable Helmer
Crown Attorney I). 1 . Holmes,
review big the. evide;ice• argued the
men were found •with powerful hunting
weapons and ammunition. They knew
there .was 'no open season for deer in
Huron county. Their explanation was',
they tired at rabbits and so forth.
According to .one witness there were
numerous shots in the bush that morn-
ing. A hound was seen chasing a, doe
in the same block as the teen. There
was no other dog in the bush and the
fawn seen was in difficulties. Thibault,
when told to wait, puts into thebush
and gets- in touch with others in the
party, and finally all come to the car,

hibits, are used for heavy game,
Frank Donnelly, K.C., defence coun-
sel, submitted there was no prima facie
evidence that the men were hunting
deer. They said they were not "bay-
ing," and t 1e fact that the 20 -gauge
gun was left -iii Lucknow -was the
strongest- proof that the party was not
hunting deer. Thibault's action was
a natural one, through fear of his gun
being confiscated. •
In reply, Mr. Holmes contended the
