13obler Case Again Adjourned.
On Tuesday evening, Aug. 28, Mr. J.
U. Statibury received the tollowing
telegram from Godericht "Thehaee of
Davies Packing Co. against nobler ad -
pureed for ten days. Writing pat tic-
ulars.”-G. A,. floraber.
No letter arrived Wednesday morn-
ing in explanation.
.A.5 we stated last week the case of
Davies versus Bobier came up for Wel
at the Town Hall on Wednesday of
last week, The Davies Company to
Whom Mr. Bobier shipped a ear of hogs
on Monday, August eth, had Mr. no-
bler arrested on a charge of fraud to.
the extent of $14-.74, which they claim-
ed Was an overcharge. Bailiff Either
of Zurich served the warrant on, the
previous Monday. ° At the trial on
Wectineeday before Pollee Magistrate
Unliaber of Goclerich the evidenee
showed that Mr. nobler had. purchased
30 hogs Oh Monday, July 80th, but not
having a Carload he turned them in-
to his piggery with others to be fed for
a week, and on August Otb, not being
able to oleic out the exact hogs, he
weighed out a like -inunber (30 hogs)
which showed a gain of 240 pounds.
They were then shipped taPalmerston,
but the house being overcrowded they
were re -shipped to Harrieton, thus be.
ing two nights _eget the read. The
shrinkage was 'consequently heavy,
some 19e to the hog, while for one
night on the road theshrinkage is 05-
ually from 11 to 12 lbs. Mr. Wright,
boo keeper for the -Davies Packing
Oorepaoy Was unable to say what the
ekrinkaee ought to have been for two
neghte on the road. Several farmers,
teem wham Mr. Bobier bad purchased
these hogs, testified to the correctness
of Mr. Bobier's accounts with them.
For the defense Messrs, Bobier, Mack,
Eseery and Tucker were examined.
Mr: Bobier's and Mt. Mack's evidence
showed that when they arrived at the
station to ship hogs on August eth, the
„train was already in the yard and it
was impossible to take the hogs from
the piggery and weigh thein before
weighing those the faerners were al-
ready bringing' in, consequently it was
impossible to know just what each
batch of hogs had gained in weight,
however, it was ascertained that they
bad increased 240. lbs. as his checks
showed. To show that this was not
an abnormal increase in weight Mr.
Stan bury produced the evideece of two
reliable farmers who have made a prac-
tice of weighing their bogs frommeek
to. week, Mr. Essery and Mr. Pecker,
which evidence showed that hogs fed
as Mr. Bobier's were, on butter milk
and chop, should gain for two to three
pounds per hog per day, while the
weight put on in this case was less than
one pound per day per hog. From
slips returned from the Collingwood
Packing Ogre pany .to whom Mr. Bo -
bier shipped hogs in 1905 it was shown
that the shrinkage for 48 hours on the
road was from 15 to 25 lbs. pe r hog, so
that it would appear that the shrink-
age of.19e lbs. was not excessive.
The court closed about 1:30,the mag-
istrate withholding his decision until.
Wednesday, August 29th, at 10:30 a.m.
Death of Lily Willis
It is not often that we are called up-
on to record so sad and sudden a death
as it is our duty to chronicle this week.
We refer to the sudden death of Miss
Lily Willie, whose home is in Marlette;
Mich., and who arrived here Saturday
evening to visit for •a time with her
relatives and friends, her home being
-
a few years since on Huron streeneast
of the town. She, accompanied by
Birdie and Lillian Boyle, daughters of
Mr. and Mrs. Thomas Bode of town,
who have been spending the holidays
there, arrived -on the , 6 o'clock train
and.were met at the depot by Mrs.
Boyle. Together they commenced to
ewalk to the horde of Mrs. Boyle, car-
rying their grips with them. They had
only, proceeded about three hundred
anis when in answer to a question
isa Willie stated that she had not
been feeling well and that they would
test for it moment. The •words bad
scarcely been uttered vvlaen she sud-
denly fell forward moon the sidewalk
and died immediately. Word Was sent
to the coroner, Dr. Browning, at once.
He wao away and Dr. Mafloy wati Gum -
moped, together with Constable Bit -
nett. In the dodoes opieion an ine
quest WAS unneeessary. The under.
taker was therefore sent for and the
body removed to the 'home of her aunt,
Mrs. Geo, Eaerett. The shock to Mro.
Boyle and the 'children was a vas? se-
vere one; its indeed it was to the young
lady's other relatives,,and friends in
town, all of whom exptese the sineete
est sympathy for the parents, Me. and
Mrs. John Willie, her brother, Fred,
and sister, Mists Violet, all of whom
reside in Marlette. Deeeased was aged
