Hunter levied fines and jail terms on a variety of charges including fraud, breach of probation, drinking and driving and having care and • control of a vehicle while having a blood alcohol content over .80 and possession of drugs. Narcotics possession Eric Bygden of Arva was ordered_tp jail for 40 days on a charge of breach of probation and another for possession of 11 COUrt a narcotic. The jail term will be served intermit- tently in London from Saturdays at 9 a.m. to Sundays at 6 p.m. Bygden was stopped in Exeter at 1 1:30 p.m. on May 9 of this year by Constable Kern. The OPP officer found a smell of drugs in tpe ve- hicle along with a wooden pipe and a small amount of marijuana. It was learned Bygden was on probation from an earlier charge of pos- session in London and a condition of the probation was not to use al- cohol or drugs. Issue Bench Warrant Judge Hunter ordered a bench warrant against Beverly Gardner of Hensall who faces 26 charges of fraud committed between June 15, 1993 and January 31, 1994. At the June 14 sitting, the court was told Gardner was having med- ical treatments in London daily and could not attend court. At that time Judge Hunter asked that a doctor's certificate be provided for June 28. Since that order, the crown and Gardner's lawyer said they had not had any contact from her, thus the warrant was issued. Driving with alcohol content over 0.80 Richard Clarke of Dashwood was fined $750 when he pleaded guilty to a charge of operating a vehicle while his blood alcohol con- tent was over the prescribed limit of 0.80. The court learned Clarke was stopped by police at 12:25 a.m. on May 23, 1994 when his vehicle was observed to be veering on and off Highway 21 in Stephen township. A smell of alcohol was detect- ed on his breath and his speech appeared slurred. At the Exeter OPP detachment, breathalizer readings of 1.30 and 1.20 were registered. C Care and control while content over 0.80 A fine of $1,200 was levied against Debbie Wilcox of Kippen on a charge of having care and control of a vehicle while having a blood alcohol content over the limit of 0.80. She was convicted on a similar charge in 1987. At 2.35 a.m. on April 2, 1994, Wilcox had stopped at Erb's service station in Hensall to obtain a soft drink. She was observed to be swaying while walking by OPP Constable Chisholm. At the Exeter OPP detachment breathalizer readings of 1.30 and 1.20 were record- ed. Jailed for fraud Shelley Young of Dashwood was ordered to jail for five days on a charge of fraud which stemmed from an incident in Exeter on July 27, 1593. On that day, Young purchased $60.34 worth of groceries from Seip's valu-mart and paid with a cheque drawn on a bank account which was opened earlier the same day and did not have any money in it. t In meting out the jail sentence, Judge Hunter noted the accused had been on probation a number of times for similar offences since 1987. Jail term for over .08 Robert Davidson of Usborne township was sentenced to 21 days in jail after Judge Hunter heard evidence concerning an incident on Highway 4 at the southern edge of Exeter on December 18, 1994. Davidson was stopped by police during a routine RIDE check on that date. He was observed by Constable Weverink to be approaching the checkpoint in a very slow manner and was edging to the right side of the road. Weverink testified there was an odour of alcohol in the vehicle and the accused had a red face and bloodshot eyes. On the witness stand, Davidson explained that he had consumed seven bottles of beer from 11:30 a.m. on December 17 until later in the evening of the same day. He said he had been doing some weld- ing and drywalling for a friend earlier in the day which was responsi- ble for the bloodshot eyes and red face. Davidson said the slow driving was because he had just exited from Norwood Village only a short distance from where he was stopped. Breathalizer tests at the Exeter OPP detachment recorded readings of 2.00 and 2.00 at 1:15 a.m. and 1:33 a.m. The defence argued that the breathalizgr tests were not acceptable as the officer in charge took a long time in preparing the machine and did not seem to know what he was doing. On the witness stand for the defence, Dtk' Michael Ward, a forensic technologist from London said for the amount of alcohol consumed by; Davidson during the, time described, the readings should have been between zero and 0.59. In making his decision, Judge Hunter said he was satisfied the bloodshot eyes and red face came from alcohol and not from the welding and drywalling. The accused was convicted on a similar charge in February of 1991. The 21 day sentence will be served interfnittently each week- end from 9 a.m. Saturdays to 6 p.m. Sundays. —What a bright idea!
