Judge Hunter hands out fines, jail terms
EXETER - In Provincial Court in Exeter on May 28, Judge R.O.E. Hunter levied fines against five persons,
ordered three others to jail terms and set a trial date for another. In addition, numerous charges were adjourned
to future court dates.
Fined for fraud
Viengxay Inthavong of R.R. 3, Zurich was fined $300 after he pleaded guilty to a charge of fraud.
According to the Crown, Inthavong is alleged to have visited the Insta-teiler at National Trust in Exeter at
11:10 p.m. on September 27, 1995 and placed an empty envelope in the machine and then withdrew $500.
Judge Hunter also ordered Inthavong to make restitution of the $500 within 90 days and also placed him on
probation for 12 months.
Drinking, driving jail term
Dwayne Hayter, R.R. 1, Dashwood was sent to jail for 14 days after
pleading guilty to operating a motor vehicle while his blood alcohol con-
tent was over the legal limit.
Due to employment committments, Judge Hunter allowed the 14 days
to be served on an intermittent basis from 9 a.m. on Saturdays to 6 p.m.
on Sundays. His driving privileges were suspended for 24 months.
The court learned a vehicle driven by Hayter was stopped during a rou-
tine check by police on Exeter's Main Street at 1:28 a.m. on November 5,
1995. The police officer found the accused to have an odour of alcohol on his breath along with glassy eyes
and slurred speech. At the Exeter OPP detachment breathalizer tests recorded readings of 1.30 and 1.40.
Hayter was convicted on a similar charge in 1991.
Fined for failing to comply
Judge Hunter fined Benjamin Sandwith of Grand Bend $300 for failing to comply with a probation order
handed out in 1995 on a charge of marijuana possession.
On April 5, 1996, Sandwith was stopped by OPP Constable McGregor for a traffic violation on an Usborne
township road. On a search Of the vehicle, the officer found three rolled cigarettes of a narcotic.

12 months after pleading guilty to a charge of driving while his ability to do so was impaired.
The court was told police followed an erratic driver on April 30, 1995 at 1 a.m. in Stephen Township. The
vehicle driven by Brintnell stopped on Wellington Crescent in Huron Park and he was found to have alcoholic
odour on his breath and had glassy eyes. He was also uncooperative and refused to listen to police.
Fined for taking vehicle
Kristan Schenk of 429 Main Street, Exeter was fined $400 and placed on probation for 12 months after
pleading guilty to a charge of taking a snowmobile without permission from Brian's Service Centre in Dash-
wood on December 11, 1995.
Fined for drinking, driving
Randy Quesnel of Lucan was fined $750 and had his driving privileges suspended for 12 months after plead-
ing guilty to a charge of operating a vehicle with an over the limit alcoholic blood content.
Quesnel is alleged to be the driver of a vehicle heading south on Exeter's Main Street at 8:25 p.m. on March
16, 1996. At that time OPP Sgt. Sadler was forced to swerve his police cruiser to avoid an accident.
At the Exeter OPP detachment, breathalizer tests were taken and readings of 1.60 and 1.50 were produced.
• Goes to trial on fraud charges
Patricia Wigle of Usborne township was ordered to stand trial in Goderich on October 11 on a number of
fraud charges.
The charges alleging fraud against the Ontario Ministry of Community and Social Services range from June
30, 1988 to November 30, 1994.
Jailed for breathalizer refusal
Bruce Pollard of Walkerton was jailed for 14 days for refusing to submit to breathalizer tests. Judge Hunter
agreed to have the term served at the Bruce Detention Centre in Walkerton. A request for an intermittent sen-
tence was denied and the straight time was to start on Monday, June 3.
At 2:22 a.m. on June 17, 1995 a vehicle driven by Pollard was stopped by OPP Constable George Finch dur-
ing routine patrol on Highway 4 in Stephen Township.
When stopped the accused is alleged to have had an odour of alcohol on his breath, had glassy eyes and
slurred speech. On four occasions he refused to submit to the breathalizer tests, which brought on the charge
of refusal.
Probation breach gets jail term
Judge Hunter levied four 15 day jail teens to be served consecutively for a total of 60 days against Stanley
Partridge of 193 Victoria Street, Exeter on charges of breach of probation, failing to comply with bail condi-
tions and failing to attend court.

Magic show entertalns
EXETER - Do you believe in
magic?
Accompanied by mysterious
stage smoke, this old tune was
played to introduce John Kaplan's
Magic Bus Show at the South Hu-
ron Recreation Centre on May 27.
Other hit songs such as Dirty
Laundry and Don't Worry, Be Hap-
py were included as Kaplan and his
five -member crew put on a family
show consisting of updated ver-
sions of traditional magic as well as
acting, humor and audience in-
volvement.
Sawing a lady in half in 1996
could be considered politically in-
correct, he pointed out. That's why
he chose Lions member Paul An-
gell as his victim.
"Are you married?" the illu- '
sionist asked Anstett before he per-
formed what he called "the Magic
Bus Show diet plan". "Now you'll
know what it's like to be separ-
ated!"
Another twist on this traditional
trick included strapping him to a
cutting area completely visible to
the audience rather than using a
concealing case.
Kaplan used volunteer help on
various occasions. He entertained a
seven-year-old girl with teasing
conversation and animal balloons.
He also appeared to make her float,
unsupported, on a surf board.
To the tune, 1 Want to Hold Your
Hand Kaplan amused a blind -

folded woman by sitting her on a
stool and performing hand tricks.
The highlight was when he ap-
peared to produce a live hand in a
cloth. To reward the woman for her
cooperation, he presented her with
a book of magic hand tricks to take
home.
"What makes the show unique,"
said Kaplan while relaxing back-
stage between acts, "is the inter-
action with the audience."
Claiming one of his strong points
is acting spontaneously, he ad-
mitted even when things go wrong
during performance, it's not a big
deal and in many cases, the audi-
ence isn't even aware.
Kaplan's show also included es-
caping from a straightjacket to she
tune of Turn Me Loose and strip
tease music.
He doesn't see himself as a typ-
ical magician.
"I'm a bit off the wall," he tyc-
plained, adding his music choices
are integral to his act. "That's pet
of who I am."
He said he's always incorporated
music in his magic shows. When he
was about 13, he pulled off a flow-
er petal trick to the tune of Tiptoe
Through The Tulips. For one of his
current tricks, he sings his own rap
song.
Following his first gig in Exeter,
Kaplan's tour takes him to Port El-
gin, Shelburne, Ottawa, the Mar-
itimes, then back home to Van-
couver.
