Four jell terms Ievled
EXETER - In Provincial Court in Exeter on December 12, Judge
R.G.E. Hunter handed out jail terms and fines on a variety of charges
ranging from drinking and driving to assault, theft, forgery and danger-
ous driving. In addition, charges against close to 20 other persons were
remanded to later court dates.
Dangerous driving fines

area was fined $300 on a charge of
dangerous driving resulting from an
1t incident which occurred in Hay
` In court township on July 2, 1995.
On that date, a vehicle operated by
Upthegrove was parked in the Elmwood subdivision, north
of Grand Bend near the residence of his common-law spouse. When
someone came out to see why he was there, the vehicle took off sud-
denly spinning.the wheels and made a sudden left turn to speed away.
It came close to hitting the enquiring person.
In Upthegrove's defence his lawyer said his client had a previous
good driving record and at the time of the incident was highly emotion-
al from a domestic dispute. A dangerous driving charge was dropped
by the Crown. Glenn Kenney of Woodham was fined $400 on a similar
charge of dangerous driving. The charge arose from an incident on
Highway 83 in Usborne township on July 29, 1995.
After a dispute with his common-law spouse Kenney was trying to
overtake her on the highway acid when she failed to stop her vehicle he
pulled up beside her trying to get her to pull over. He was able to edge
her vehicle over to the side of the road on three occasions. An eye wit-
ness reported the incident to police.
In defence, lawyer Kim McLean said his client's vehicle never
reached a speed of 40 kiloti:etes per hour and there wasn't any vehicle
contact. Another charge was withdrawn.
Drinking, driving fine
James Smith of Huron Park was fined $850 and had his driving privi-
leges suspended for 12 months after pleading guilty to operating a ve-
hicle with a blood alcohol content over the legal limit.
At 1.20 a.m. on September 23, 1995, Smith's vehicle was observed
leaving a parking lot on Exeter's Main Street. It was proceeding slowly
and hesitantly in a southerly direction when stopped by police. The ac-
cused was found to have a strong odor of alcohol on his breath and
slurred speech.
At the Exeter OPP detachment, breathalizer readings of 2.65 and
2.68 were recorded.
Jailed for assault
Judge Hunter sent Kelly McAdam of Mitchell to jail for a period of
three months. McAdam was found guilty of assault at a previous court
appearance in Exeter and the sentencing followed a pre -sentence re-
port.
In his defence, McAdam said, " I am sincerely sorry for what hap-
pened and one of my future goals is to keep my family intact and never
pick up a drink again. "
After hearing the accused's employer was supportive and willing to
have him continue work, Judge Hunter made the jail sentence to run on
an intermittent basis from 9 a.m. each Saturday to 6 p.m. each Sunday.
Trial delayed
A scheduled trial to hear charges of sexual assault against Albert De-
fauses of Tecumseh was delayed until February 27, 1996 because de-
fence witnesses were not available.
The incident in question occurred on March 23, 1995 in Usborne
township.
The defence lawyer attempted to get the charges dropped as the two
witnesses originally subpoenaed in October and again later have not
been found, but Judge Hunter ordered a re -appearance at the February
27 court date.
Fined for drinking, driving
Michael Vessie of Hanover was fined $750 and had his driving li-
cence suspended for 12 months after pleading guilty to a charge of op-
erating a vehicle with more than the legal limit of blood alcohol in his
system.
At 11.48 a.m. on October 1, 1995, two Ontario Provincial Police offi-
cers on patrol saw a vehicle go through a red light at the intersection of
Main and Huron Streets in Exeter.
The officers followed the vehicle and it reached the north end of Lu -
can before being stopped. The driver was found to have a strong odor
of alcohol on his breath and admitted to police that he had consumed
four beers.
At the Exeter OPP detachment breathalizer tests were taken and re-
sults were 1.80 and 1.70.
Jailed six months
Judge Hunter ordered Burton Rock of Parkhill to serve six months in
jail after he pleaded guilty to operation of a vehicle with a higher than
the prescribed limit of blood alcohol content in his body. His driving li-
cence was also suspended.
At 7 p.m. on May 25, 1995 , Grand Bend OPP officers were dis-
patched to Highway 81, just south of Grand Bend where the accused
apparently missed a turn in the highway and went into a field. When
officers arrived he was rocking his vehicle back and forth trying to get
out.
Police found an open bottle of beer between his legs in the driver's
seat and found the accused to have a strong odor of alcohol and had se-
vere diffculty in producing his identification.
The court learned Rock has served previous jail terms on similar
charges on three occasions dating back to 1991.
Another six months sentence
Dwight Trotter of London will spend the next six months in jail after
pleading guilty to uttering a forged cheque and theft of a public utility.
Trotter was convicted of depositing a cheque for $3.000 at National
Trust in Exeter on August 15 and over the next eight days withdrew the
entire amount in smaller amounts until the account was declared de-
funct.
The man who's name Trotter forged was able to convince the Bank of
Montreal that he didn't Write the cheque and was reimbursed.
At about the same time. Trotter rented an apartment in Exeter, but
couldn't get electricity hooked up because he didn't have the necessary
deposit.
Instead, he hooked up the utility himself and left the apartment owing
the Exeter PUC a total of S29.65.
The accused has a previous record including theft of telecommunica-
tions in Walkerton in 1995, failing probation and mischief in Kincar-
dine in 1992 and false pretences in Stratford in 1984.
He was assessed five months on the charge of forgery fiiicl one month
for the theft of a utility.
Jailed for 30 days
James Stuart of Crediton was sent to jail for 30 days and had his driv-
ing privileges suspended for 12 months as the result of an accident on
October 7, 1995 at the intersection of Highway 4 and Huron road 4.
On that day, Stuart is alleged to have gone through a stop sign on the
county road at a speed of between 60 and 80 kilometres per hour and
struck another vehicle causing injuries tO two occupants.
When found by police. the accused had a strong odor of alcohol on
his breath and slurred speech. At the Exeter OPP detachment his brea-
thalizer readings were 2.30 and 2.30.
In his defence Stuart told the court, he was depressed over a com-
mon-law relationship shutdown. He, said he has no other explanation
for his actions and added." 1 am remorseful and it was a stupid thing to
do. I recognize it's a very serious charge and I could have killed two
people."
To get peace bond
Michael White was placed under a peace bond for one year after
pleading guilty to a charge of assault. He was also ordered to not have
any contact with the female victim.
