OPP test breathalyzers
Lions learn moderation is best
Several members of the Ex-
eter Lions club volunteered
Thursday to be human guinea
pigs -to assist in
demonstrating how the OPP
breathalyzer test works.
Constable Wally Tomasik
didn't take tong in convincing
the club three or more drinks
could result in an impaired
driving charge. Police have
the right to spot check any
automobile and if the driver
is suspected of being under
the influence of alcohol, a trip
to the station and the
breathalyzer -machine usual-
ty results.
Bruce Shaw carefully
monitored the varying
amounts of alcohol consumed
by five other Lions who
volunteered to drink in the in-
terest of science. While some
didn't show any outward
signs of being impaired con-
stable Tomasik's machine
soon showed otherwise. Be

the test would have been real
instead of an experiment

A brochure handed out by
constable Tomasik explains
the drinking driving laws and
follows the events that occur
the moment you drive away
from a party to the time you
are convicted of an offence.
As you drive along you may
think you're doing just fine. In
your mind the impaired
driver is the one who swerves
all over the road and adver-
tises the fact that he or she is
impaired. There is no doubt
this type of driver will be easi-
ly detected by police. But
what about the driver who
drinks and proceeds in an ex-
tra cautious manner?
If you believe the police
can't stop you, you're wrong.
Under provincial legislation
the police can stop you at any
time. The officer can then de-
mand you provide a sample of
your breath if he suspects you
have been drinking. Because
Wally Tomasik has received
all the required training to
operate the breathalyzer
machine he'll be the person
you meet when you're taken
back to the local station for
additional tests.
If your blood alcohol count
is more than 80 mg percent
you are guilty of an indictable
offence or an offence
punishable on summary
conviction.
As well, failure or refusal to
comply with all demands for
a breath sample is an indic-
table offence and carries with
it the same penalties that are
handed out to someone whose
blood alcohol content is over
80 mg percent..
The law also recognizes you
can be impaired at levels
lower than 80 mg percent.
Factors such as fatigue.
drinking experience, drugs
and emotional state can in-
teract with alcohol and result
in impairment long before
your blood alcohol content
reaches 80 mg percent.
A first offender could
receive a maximum fine of
$2,000 or a jail sentence of six
months, or both. The second
time around could bring a
penalty of up to one year in
jail. Sentences handed out in
Exeter however do not usual-
ly come anywhere near the
maximum, but conviction is
still costly and embarrassing.
