Former area boat builder
faces continuing adversities
Adversity is nothing new
for Howard Hughes, former
owner of Hughes Columbia at
Huron Park, but the man who
has rebounded from business
losses in the past is tackling
a new foe now.
The following story, written
by Lorne Slotnick of the Globe
and Mail, details the latest
battle being fought by the
former boat builder.
Another winter storm
sweeps through southern On-
tario and the burned -out
house on a back road near
Orangeville fills with snow.
"The pipes are frozen now,"
says the owner, Howard
Hughes. "You can't heat a
house with no roof.
Hughes, 50, used to be a
millionaire with big ambi-
tions, but his sights are set
lower now. He just wants to
fix up his home and move out
of the trailer where he, his
wife and three children have
lived for three months.
But Hughes, can not get the
insurance moey to repair the '
house - it's tied up in limbo
because Revenue Canada
wants it.
"I'm not a high-profile per-
son. I've tried to deal with this
without making waves," Mr.
Hughes says in a quiet voice.
"But I'm getting very, very
angry." He feels federal
bureaucrats are kicking him
while he's d9Wn, all for a
540,000 tax claim he believes
is dubious, and under legisla-
tion that wasn't even in effect
when the claim arose.
Two years ago, Hughes
company, Hughes Columbia
Inc., was the second largest
manufacturer of pleasure
boats, with 250 employees and
a main plant in Centralia.
Ont. The recession hit him
hard, and, as he puts it, "the
dominoes came tumbling
down quickly." In June, 1982,
the company went into
receivership.
When the receiver moved
in, the company had not yet
remitted to Revenue Canada
the 535,000 deducted the
previous month from
employees' pay cheques.
Ilughes says the money
wasn't even due for another
week.
"But in any event, Revenue
Canada made a deal with the
receiver to stand down so the
employees could get their last
two weeks' pay," Hughes
said. "They agreed to forego
the taxes, and as far as we are
concerned. Revenue Canada
had gone away."
In March of this year, the
company was sold off by the
receiver. Hughes continued
working for the new owners
until October - six weeks after
an arsonist gutted his 8300,000
home. (Police confirm the
fire was arson, but have not
charged anyone.)
Shortly after the fire, which
his three children narrowly
escaped, Revenue Canada
was back, armed with new
retroactive legislation that
made directors like Hughes
personally liable for tax
claims against companies.
"They went after my bank
accounts, but there wasn't
anything in them . Then they
put in a third party demand
on the entire proceeds of the
insurance of November, ef-
fectively stopping all
rebuilding on the house. 1
can't replace our clothing,
furniture, or any personal
effects."

adjuster on the case, says

started but the rest of the
money is now in limbo
because of Revenue Canada's
claim. Hughes says he is sup-
posed to get more than
8200,000 in insurance money,
5187,000 alone for the house.
Right now, he says he is just
living on his savings.
"When I got notice (of
Revenue Canada's claim), I
called . them. We had our
backs to the wall; we had just
the clothes on our backs, no
personal effects, my house
was destroyed, and I was
fired, and they tell me, I owe
540,000 for 'a default that
wasn't mine."
"Any money we had in the
bank, I had to take out before
Revenue Canada could get
it," he adds.
He says an official from
Revenue Canada's Kitchener
office told him three weeks
ago that tax officials would
hound him until the day he
died and that after he died
they would hound his estate.
"They told me they never
forgive and they never
forget."
Hughes says he took the
case to his MP, Tory revenue
critic Perrin Beatty, and call-
ed deputy revenue minister
B.A. McDonald. He says he's
"heard nothing", from the
deputy minister.
MacDonald said in a
telephone interview that he
cannot comment on the
Hughes case because of the
confidentiality provisions of
the Income Tax Act "Our
department is engaged in the
collection of taxes," he added.
"If assets are available we
will attempt to realize on the
assets."
The Kitchener office of
Revenue Canada has been
cited recently by Mr. Beatty
and other Tory MPs who are
waging a campaign against
what they charge is unfair
treatment of taxpayers by the
department. The Tories say
tax auditors are operating
under a quota system which
encourages harassment.
Asked about the Hughes
. situation, Mr. Beatty said that
"in more than 11 years in
Parliament, I've never seen a
case like this... This ex-
emplifies the tactics being us-
ed by Revenue Canada.

"The tax department is a
rogue elephant running out of
control," Mr. Beatty said,
"because of the pressure
that's being put on to turn the
screws and extract money by
any means."
Both he and Hughes con-
demn Revenue Canada for
not negotiating or discussing
the issue, but rather putting a
claim on the money im-
mediately. "Can't they let
him get back on his feet and
pay it back at a reasonable
schedule?" Mr. Beatty asked.
"If they drive him into
bankruptcy, they won't get a
penny."
Hughes says neither he nor
his wife has any income, and
with his savings running out,
he is intending to apply for
unemployment insurance. He
has filed an appeal of the tax
department's claim on his in-
surance money, but as things
stand, he cannot get any of
the money at least until the
appeal is heard several
months from now.
"They say that if it takes
two years they can wait,"
Hughes said. "They are the
most abrasive objectionable
people in the entire world."
When his business was
booming, he said, he paid
"many many millions in
taxes... But when you hit bot-
tom, the bottom's an awfu;
long way down.
If we have an' obligation,
we'll pay it. But all we've ask-
ed Revenue Canada to do is to
allow the courts and the ap-
peal process to establish
whether we're liable before
they take the money "
