Times Advocate, 1999-10-27, Page 44 Exeter Times -Advocate Wednesday, °cumber c , , 77. Possible legal confrontation on Airport Drive issue By Scott Nixon TIMES -ADVOCATE S1'AFF LUCAN BIDDULPH — Thh township may be heading towards a legal confrontation regarding Airport Drive. As previously reported in the T -A, Lucan Bid- dulph resident Fred Lew- is has asked the mu- nicipality to upgrade and maintain a 1,400 foot section of Airport Drive between the Roman and Saintsbury Lines. Lewis is planning on building two chicken barns on property he owns on. Airport Drive and will need an up- graded road for his trucks. The argument between Lewis and the municipal- ity is whether or not the Toad is officially open. Reeve Earl French has said if the road is still an open road, the township will have to maintain it up to standards; if it is closed, though, it is Lew- is's responsibility. Lewis appeared before council again at its Oct. 19 meeting restating his case. He said Airport Drive has been recognized as a road because it appears in the most recent County of Middlesex map. He alio said there is evidence of gravel and ditching on the road. He said the road was open when the township was established and he is not aware of it ever being closed. Lewis, who said he's lived his whole life in the area, remembers Airport Drive being used when he was a child but main- tenance stopped because there was no need for it. Township ad- ministrator Ron Reymer said the township works supervisor remembers doing ditching work on the road in the last ten years, but that was for drainage purposes, not road maintenance. At that point in the conversation, French suggested closing the discussion to the public because the matter could lead to a legal confronta- tion. After the half-hour in camera session, town- ship staff was directed to get a legal opinion on road maintenance, an engineer's estimate on upgrading Airport Drive at both ends of the road and an estimate of any taxes that could be col- lected from Lewis's pro- posed chicken barns. Deputy Reeve Bob Ben- ner said Lewis has to prove to the township Airport Drive is open and he hasn't done that yet. Council also received a letter from a Lucan couple objecting to the possibility of the town, ship paying for up- grading the road. The letter said Lewis should pay for the road if he wants it maintained. No extra funds available for sewer project: province By Scott Nixon TIMES -ADVOCATE STAFF LUCAN BIDDULPH — Reeve Earl French didn't sound too op- timistic about the town- ship getting more money from the province for its Granton sewer project. French reported to council Oct. 19 about a visit he made to Toronto to talk to Environment Minister Tony Clement seeking more funds. The province will grant $853,000 towards the project but council has stated in the past other municipalities doing sim- ilar projects have re- ceived more money than ton project. what Lucan Biddulph The township was also has been promised. = seeking an extension on French, who attended getting its _already- along with township ad- promised funding be- ministrator Ron Reymer, cause the project has engineer Bob Stevenson been delayed.
