The trial which began Sept. 8, 1998, is expected to hear closing arguments this week. Sarah LeBeau, 22, is on trial on 11 charges result- ing from a• Nov. 24, 1996 Varna -area crash that left four area youth dead. Charges include four counts of criminal negli- gence causing death and impaired driving causing death. She's also charged with impaired driving, criminal negligence causing bodily harm and impaired dri- ving causing bodily harm. During last week's court proceedings the defence continued to press its claim LeBeau was not behind the wheel of her 1995 Camaro the night of the accident. A forensic analyst testi- fied last Tuesday mark- ings found on Neal Atchison's right boot are consistent with thegas and brake pedals of LeBeau's car. Don Hunks testified three. scuff marks found on the toe of Atchison's boot match the location of the ;Camaro's steel brake and gas pedal shafts and the right edge of the brake pedal. He also said those marks have "several strik- ing si amities" to a "rub- bing" he did of the pedals in the LeBeau vehicle. Hunka also testified no significant markings were found on the new pair of boots LeBeau was wear- ing the night of -the acci- dent. During cross-examina- tion, Crown attorney Bob Small School boards could be disadvantaged By Michele Greene SEAFORTH -- Small school boards in Ontario could be disadvantaged by their own associa- tion. Last Tuesday night in Seaforth, the Avon Maitland District School Board voted to pay the $38,000 membership fee to belong to the Ontario Public School Boards Association. Trustee Abby Armstrong opposed the move. She said only representatives from the province's school boards with at least 150,000 students are allowed to sit on the board as vice-presi- Morris noted there were several markings on Atchison's boots. When Morris questioned Hunka when the other marks were put on the boot he replied there were a lot of unknowns. Last week the court also heard testimony from a friend of LeBeau's Shannon McClenaghan, who was at the party and discovered the accident with a friend after LeBeau's car failed to arrive at Varna area home later that night. Trustee Armstrong said that move gives some boards more input than others. It makes some boards more equal than others and penalizes smaller boards like Avon Maitland, she said. McClenaghan testified she found both LeBeau and Gardner laying com- pletely outside the car with their feet towards the driver's side. She also said Atchison was laying out- side the vehicle towards the back of the driver's side of the car. McClenaghan said she checked their vital signs and found Atchison had no pulse and both LeBeau and Gardner were breath- ing. The court also heard testimony from Chris Ciapka of St. Thomas who said he and a friend were headed into the area to fish when they were stopped by a person wav- ing for them to stop. Ciapka was told by the person there had been an accident and directed him to the scene of the crash. Ciapka testified when he arrived upon the scene he saw two victims outside the car — one female with her head near the driver's side front tire and a male, closer to the rear tire. He said both of them were alive. Ciapka also saw a male in the driver's seat, whose legs were straight in front of him under the remains of the dashboard. During cross-examina- tion, Crown attorney Bob Morris said the first police officers on the scene and the ambulance attendants had testified the female was only partially out of the vehicle and they had to manoeuvre her foot around the gas pedal to get it out of the car. Ciapka said he didn't see anyone's foot stuck in the driver's footwell Brian Hill, 21, and Mark Webster, 19, both of Stanley Twp., and Neal Atchison and Pamela King, both 20 and from Clinton, died in the -crash when LeBeau's vehicle left County Road 31 near Varna.
