Marion lived with and was predeceased by

Mrs. Mary Pearl (Fairbaim) Clausius of Ed-
ward Street, Zurich, in her 82nd year. Be-

sius (1990) and the late Lennis O'Brien

Marjorie O'Brien of West Bay, Nova Scotia,
Douglas and his wife Beuy Anne O'Brien of

Halifax, Nova Scotia. Dear sister of Clar-

predeceased by one daughter, Jean Mary

PLANNING ACT, 1983
NOTICE OF PASSING OF A
ZONING BY-LAW BY
THE CORPORATION OF THE
VILLAGE OF GRAND BEND
TAKE NOTICE that the Council of the Corporation of the Village of
Grand Bend passed By-law 5064 of 1990 on the 17th day of Decem-
ber, 1990 under Section 34 of the Planning Act, 1983.
AND TAKE FURTHER NOTICE that any person or agency may appeal
to the Ontario Municipal Board in respect of the by-law by filing with
the Clerk of the Corporation of the Village of Grand Bend, P.O. Box
340, Grand Bend, Ontario NOM 1 TO not later than the 28th of January,
1991, a notice of appeal setting out the objection to the by-law and the
reasons in support of the objection.
The zoning by-law amendments do the following:
i) amend the definitions of "Bed and Breakfast Establishments" and
"Home Occupations" to identify Bed and Breakfast Establishment as
a Home Occupation.
ii) amend the definition of "Landscaped Open Space" to exclude walk-
ways, patios and similar structures.
iii) amend the definition of "Lot Coverage" to include buildings as well
as structures.
iv) amend the definition of "Setback", "Front Yard", "Rear Yard", and
"Side Yard" to define as being measured from the foundations of build-
ings and structures.
v) amend the definition of "Front Yard Depth", "Rear Yard Depth", and
"Side Yard Width" to refer to the main building on the lot.
vi) Lot coverage- revise the provisions of Section 5.1.1b) of the by-
law to permit accessory buildings and structures to cover 10% of the
total lot area in a residential zone. his coverage would be included as
part of the maximum lot coverag permitted for a particular zone. This
change clarifies the existing wording.
vii) Yards in Residential Zones - require a 1 m setback from both rear
and interior lot lines for accessory buildings and structures. This
would'permit access for maintenance purposes.
viii) Permitted Yard encroachments - replaces the existing wording of
the by-law in Section 5.1.2b) with a chart for easier interpretation.
More features are added to broaden the section.
ix) Number of main buildings on a residential lot - restrict the number of
main buildings in two family zones to one main building.
x) Throtbh Lots - prohibit accessory buildings and structures from be-
ing located in a required yard abutting a street.
xi) Strengthening Non -Complying Uses, Buildings and Structures to a
Safe Condition - adds a clause permitting this to the by-law .
xii) Driveway Widths - include a minimum driveway width of 6 m for
parking lots with 3-9 spaces and 7 m for parking lots with 10 or more
cars for combined ingressft;iess driveways. A maximum width of 9 m
would tie applied to accesses for loading spaces.
xiii) Parking Lots - require paved surfaces and poured -in-place curb
stops for all non-residential apd muhi-family residential parking areas.
xiv) Building Enlargements and Parking Requirements - requires that
where a development has Insufficient parking, no parking spaces may
be removed as a result of expansion.
xv) Change in Use - require that where a change in use means in-
creased parking requirements, additional spaces should be provided.
xvi) Holding Provisions - adds holding provisions to Sections 8.12
(one -family residential), 15 (Institutional) and 16 (Commercial 1) of
the by-law.
x'vii) Side Yard Requirements amend the side yard setback for the
following zones: R3.1t R3.2, R3.3, R3.7, R3.8 and 113.10 t� be 3 m.
xviii) delete "Accessory Dwelling Unit' from the list of permitted uses
in the C1.1 and C1.2 Zone and replace it with "Dwelling Unit within a
permitted commercial building". This change allows for persons other
than owners or empbyees to occupy such dwelling units.
No key map is provided because these amendments are general
amendments affecting the gntire village. The complete by-law Is avail-
able for inspection In my officL during regular office hours.
