kitchen, one bedroom and three piece bathroom on the main floor
and two additional bedrooms on the 2nd floor with a partial, un-
finished basement.
CONDITIONS OF SALE
1. The vendor shall not be required to produce any abstract of
title, deed or evidence of title, other than those in its possession.
The purchaser shall examine the title at his own expense and any
objection thereto sholl be made in writing within 20 days from
the acceptance of the tender. Should no sufficient objection in
writing be mode within that time, the vendor's title shall be held
to have been occepted. Should any sufficient objection in writing
be mode within that time which the vendor is unable or unwill-
ing to remove. the vendor shall be of liberty to rescind the sale
in which case the purchaser shall be entitled only to a return of
the deposit money, without interest, and the transaction shall be
null and void.
2. The tender shall be unconditional.
3. The tender shall be accompanied by a certified cheque payable
to The Canada Trust Company for at least 10% of the amount of
such tender. as a deposit, and the purchaser shall pay the re-
mainder of the purchase price. subject to odjustments for
municipal taxes. in cosh or by certified cheque, on or before July
30, 1982, and shall be'given possession of the property and a con-
veyance prepared of the expense of the vendor.
4. The tender and occeptonce of these conditions of sole which
shall be deemed to form port of such tender, shall constitute the
entire agreement between the purchoser•and the vendor and there
is no representation. wor anty, collateral agreement or condi-
tion affecting this agreement or the property other than as ex•
pressed herein in writing.
5. The purchaser hereby warrants that he is not o nonresident
of Canada pursuant to the Income Tax Act (Canada) and it is
understood and agreed that the provisions of The Planning Act
will be compiled with, at the expense, .if any, of the purchaser,
prior to closing.
6. Time shall in all respects be of the essence.
7. The highest or any tender willnot necessarily be accepted.
8. The purchaser acknowledges that access to the property i ; via
o right-of•way grovel road, 1.25 miles north of the intersection
of Highways Number 21 and 81.
9. This ogreement is conditional upon the purchaser being op•
proved for membership in the Kingsmere Syndicate and the re•
quired Court approval being obtained by the vendor, both condi.
tions to be fulfilled on or before Jury 30, 1982• and in the event
said conditions are not fulfilled, this agreement shall be null and
void and the deposit shall be returned to the purchaser without
interest. .
