Sunday shop legislation

The.gencral public will have the
opportunity to express their views
on "Sunday shopping" at public
hearings in August and September.
A great deal of confusion has sur-
rounded the issue; and the contro-
versy is understandable. The fact is,
the government is proposing a law
which is clearer, fairer, and more
enforceable -than what has existed in
the past. -
Both.this government and previ-
ous governments have agreed the
previous legislation had proven un-
workable and subject to widespread
abuse. For example, the "tourist"
exemption has been challenged as
unfair; the exemption for drugstores
was exploited as a major loophole;
"roping off" has become a common
practice; and the maximum penalty
- a $10,000 fine -.failed to prevent
those determined to defy the legisla-
tion and open on Sunday.s -
The proposed changes deal with
all of these abuses in a direct fash-
ion and lay out specific direction as
to who will be allowed to open on
Sundays and statutory holidays.
On April 25, 1988 two bills were
introduced in the Legislature that, if
passed, will change the laws gov-
erning Sunday openings or closings
and will provide protection to retail
workers.
Bill 113, introduced -to ainend the
Retail Business Holidays Act pro-
vides a framework within which
businesses must comply. Each
community will be given the free-
dom to pass bylaws permitting
Sunday opening or requiring clos-
ing of retail stores according to the
individual needs of the community.
Bill 114, amending the Employ-
ment Standards Act, necks to ensure
workers affected by the ncw legisla-
tion arc 9ppropriatcly'protected. it
will enable all retail workers to re-
fuse -Sunday work that they consider
unreasonable.
in addition, they can continue to
refuse work in stores which open in
violation of the Retail Business
Holidays Act.
The two bills • received second
reading on June 20th and arc going
to the Standing Committee on. Ad-
ministration of Justice for consider-
ation and public hearings in August .
and September.
The Committee begins hearings
in Toronto on August 8th. On

New strategy for consumer
protection sought •
• A comprehensive review of Onta-
rio's consenter protection legisla-
tion, the "Directions Report", has
been released by Consumer and
Commercial Relations Minister
Bill Wryc. .
The report, prepared by the Legis-
lative Review Project, brings for -
On the the kcy proposals made.by
the Legislative Review Project is
the consolidation of the basic con-
sumer protection laws into a single
statute or consumer protection code.
The code would embody the basic
rights, responsibilities and remedies
of consumer transactions..
"With the 'Directions Report' as a
guide, 1 look forward to the devel-
opment of simplified yet-compre
hensive consumer protection laws
that will take us into the 1990's and
ward proposals that would assist in -6
the development of a new consumer
protection strategy for Ontario.
The Ministry of Consumer and
Commercial Relations has already
made preparations to review the re-
port. Following public consults=
tions, specific legislative proposals -
will be developed and -brought for-
ward for consideration.
The report's proposals are based
on basic principles of fairness:
* Reasonable disclosure of infor-
mation;
* Transactional fairness;
* Fair value, or reasonable value
for price paid;
* Reasonably available and ac-
cessible consumer remedies or dis-
pute resolution mechanisms.
