Draft five of Official Plan in public hands

Lambton Short's council have been
working on the Official Plan since 2007
-it is now in its fifth draft. Because of
time constraints at the November 7th
sleeting, the OP will come hack to
council this week.
The Municipality's Official flan lets
the public know what the municipality's
general land use Planning Policies are;
Makes stere that growth is coordinated
an(1 meets the community's deeds;
I ielps the community understand how
lands may be used now and in the
future; Ileitis decide where and when
oroads, watermains, sewers, garbage
umps, parks and other services will be
- uuilt; Provides a framework for estab-
lishing municipal zoning by-laws; and
Shows Council 's commitment to
growth and (development
At the November 7th meeting Plan-
ner Patti Richardson recommended
that council receive the draft and in
order to keep the public informed and
engaged, it was recommended that
Council approve that Draft 5 of the
Lambton Shores Official flan he placed
00 the Municipal Website; That the
public be advised on the Municipal
website that Compact Disk copies of
Draft 5 of the Lambton Shores Offi -
cial Plan are available from the Planner
upon request; That the public he
advised on the Municipal website that
any comments or questions respecting
Draft 5 of the Lambton Shores Official
Plan be forwarded in writing to the
Planner;'ihat a copy of the anticipated
schedule for the Official Plan review
process as approved by Council on
October 3, 201:1 he placed on the
Municipal website and that printed
c'opie's of Draft 5 of the Lambton Shores
Official i'lan he placed in all Lambton
Sores Municipal Offices and libraries.

Councils have no power to make plan-
ning decisions that are not consistent
with Provincial Policy. That power was
taken away by the 2004 amendment to
the Planning Act. If the Council purports
to slake a decision that is not consistent
with provincial policy, that decision will,
upon request, be set aside by a court or
by the (MIS as the case may be.

cies, community associations, interest

ing on web on August 10, 2009.

'Ihe 3rd revision was reviewed by Steer-
ing Committee and staff in June of 2010.
The Committee and staff were still
not satisfied with draft, so over the next
few months the draft was revised by
Lambton Shores Planner
4th Draft was presented for review by
Steering Committee on April 20, 2011.

the Lambton Shores Official Plan on
April 20, 2011 at their 5th meeting.

meetings were held.
NOVEMBER 2013
Staff recommend that prior to Coon
cit review of the 5111 Draft ol'the Lamb -
ton Shores Official Ilan commencing
that Staff provide Council with:
• A copy of revised draft (5'1'11) Official
Plan;
• A list of outstanding issues;
• A copy of Official Ilan Background
Studies;
• A copy of the development land
inventory;
• A copy of the Official Platt Steering
Committee Minutes;
• A copy of all continent letters received
to date.
Once this information is received by
Council and they have had a chance to
review the information, Staff recom-
mend that Councils' review proceed as
follows;
Staff review with Council the Plan-
ning framework 011 which the draft offi-
t'ial plan was prepared;
• Staff review with Council major
changes from Current Official Plan to
Draft 5;
• Staff review the comment letters

• 'That a series of Public Open !louses be held to solicit the
Lanlhton Shores residents' and property owners' comments
on the Plan;
• That the Plan be circulated again to all Agencies for
comment;
• 'That upon completion of the public open houses and
agency review, staff prepare a report for Council review and
direction identifying any issues identified as a result of the
public open houses and agency review;
• 'I'Ilat Staff revise the Draft Official Plan as directed by
Council; and
•That the public meeting for the 1)raft Official flan required
t nder the Planning Act he scheduled.
