Rules and ramifications for dock leases
4) Dockers required to sign
municipal agreements

It has been a long time coining, and Lamb -
ton Shores councilor Doug Bonesteel is
pleased the finger dock issues are being dealt
with.
Lambton Shores clerk Carol McKenzie
explained the background of the dock
concerns.
"At the Council meeting held June 20th,
£l3, passed a resolution for the signing of
Tlntal agreements with Lambton Shores. One
of those agreements is to lease the finger
docks.
She said the issues that were identified were:
Construction of permanent structures - sun
shades, B -B -Q's, use of fridges or satellite sys-
tems, etc. that are in violation of the rules and
regulations.

"Since June 20, staff have been apprised of
additional issues, whereby dockers have left
cars on private property and blocked the
egress/ingress of residents, and have been
reported to be camping on both public and
private lands. The By-law officer has beenad-
vised of the parking and tenting issues, and is
able to issue warnings or tickets."
Matters such as trespass to private property
can only be dealt with by the OPE and McKen-
zie feels they have been apprised of the situa-
tion by the property owner.
"While it is believed that it was one of the
transient dockers that was tenting and parking
in a discourteous manner, a letter is being pre-
pared and sent to the current dockers, asking
that they use common courtesy when at the
docks, parking, or entertaining guests," she
said.
Going forward:
At the time of the lease agreement renewals,
dockers are advised to keep in mind the rules
and regulations regarding the number of deck
boxes, and other items that are prohibited;
however, says the Clerk, there hasn't been a
process established to enforce the provisions.

dockage is a standard form used by public and
private marinas across Ontario and endorsed

One of the rules states that the boat "owner
agrees that he will not store supplies, accesso-
ries, debris or other material on the docks and
that he will not construct thereon a locker,
chests or other structures without the written
permission of the marina':
The agreement does not cover materials
constructed on the municipal property adja-
cent to the docks. It is proposed that for 2014,
rather than use a standard fords, a new Lamb -
ton Shores agreement be drafted that wi11
clearly state the rules, regulations and expecta-
tions and deal with our site specific issues. A
section will be included that deals with breach
of agreement and \vhitt constitutes a breach.
Questions asked and answered regarding Southbend

Southbend Estates, a long time devel-
opment south of Grand Bend is going
forward and owner Allan Drewlo vice
president of Drewlo Holdings Inc. came
to Lambton Shores council last week to
hear a delegation that centred on his
property.
Resident Bob Sharen had sent 211
questions to council some five regard-
ing his concerns about Southbend
Estates and the development agree-
ment signed in 2011.
Lambton Shores staff responded in
writing to Sharen's concerns but the
Grand Bend num did not consider the
answers sufficient. Speaking for Sharen,
Richard Matzka asked mayor Bill Weber
if he or the staff felt their needed to be
any changes to the answers they pro-
vided. Weber said "no:" Matzka then
said since a 10 minute delegation was
d•7tlot enough time to deal with the guy -
would it be possible to sit down
with new (:AO Kevin Williams so that
Sharen could have closure to the mat-
ter." Your questions have been asked
and answered," Weber said. "Mr.
Sharen feels the questions were not
answered to his satisfaction," stated
Matzka.

opment agreement, the subdivision
agreement, agreements with the new
owner, agreements with the former
owner, by-laws that went with the
property
Matzka suggested since Sharen had
waited so long for his questions to be
answered, that it would be better for
council and all involved for secondary
answers- answers that were not so
short. Council did not agree to Sharon's
suggestion but encouraged 111111 or his
spokesperson to continue if they had
more questions.
"Mr. Sharen feels we are not getting
anywhere," said Matzka as they com-
pleted their delegation.

lhe Lakeshore Advance spoke with Drewlo who said that
they have net with Ministry of Natural Resources and Minis-
try Of Transportation in the spring and are going forward.
"We have just completed those reports and we will be sub-
mitting them for review so that we get the ministry require-
ments to proceed. This property was purchased this past
spring. Ile said they are very excited to begin this project.
A new Ministry of Natural Resources study had to he done
for Species at Risk and they had to start from scratch for
entrance access with the Ministry of 'Transportation- but
once those issues are satisfied, they can begin.
Allan says, "Drewlo I ioldings has a long positive history of
developing and building in Southwestern Ontario including
London, Kitchener, Sarnia, Woodstock and Burlington and
expect that (rand Beni will also be a positive for everyone."
Southbend has been on the books for decades. 'there was a
site plan in 1993 on a much smaller scale than what has been
agreed to today. 'through the original 1993 plan the park ded-
ication was male which is now the Kion(iyke Road soccer
pitches.
Breach of Agreement:
The dockers will be required to sign
an acknowledgement of the rules and
the ramifications for violations and sub-
mit with their dockage payments.
In September, a letter will be sent to
all current dockers advising them that
the term of the lease is from Mid May to
mid October, and that at the end of the
2013 lease terns, all items that have
been installed or left on the municipal
property will be removed. 'ihe letter will
ask the dockers to remove all personal
property and/or materials/structures.
