Cash in lieu waived for J -Dees for trial period

This is it resumption -not a new business,
explained I.anitlton Shores councilor Doug
Bonesteel in his bid to waive the cash in lieu
costs for 1 -Dees Summerhouse In (rand Bend.
After much discussion -council agreed for this
summer of 2013 trial period.
At their meeting o11 July, 1, 2013, Council
considered Planning Report No.
31-2013 respecting sidewalk cafes and patios
and the display of goods, wares, merchandise
and articles on municipal sidewalks in Lamb -
ton Shores and approved the staff
recommendations.
The Municipality received on July 9, 2013, an
application from Craig Paulger of 1Dee's Sum-
merhouse, located at 23 Main Street West, in
(rand Bend, requesting approval to establish a
sidewalk patio on the municipal sidewalk
located in front of their existing restaurant.
Stuff reviewed the application to ascertain
compliance with Council's recently
adopted policy respecting outdoor patios on
the municipal road allowance and advised the
owner of 11)ee's Summerhouse, Graig Paulger
by telephone on Thursday, July 11, 2013 that:
• The liquor license submitted did not indi-
cate that it applied to the outdoor patio
on the sidewalk and that the license expired
in four days on July 15, 2013. Staff
requested a copy of the new liquor license
told proof that it applied to the outdoor patio;
• 'l'hat the encroachment agreement for the
property would be sent to the (;rand
Bend office for Friday horning for Mr.
Paulger to pick up, sign and return.
• That the rental fee payable to the Munici-
pality as required by Councils' new
policy was $1500.011

THE PROJECT:
'lite Municipality of liluewater has initiated a Municipal ('loess Environmental Assessment (Class
EA) process to develop a Stonnwater Servicing Master Plan for the Hayfield Settlement area. The
Master Plan will inventory and evaluate existing stonnwatcr facilities within Bayfield and investigate
the most cost effective and efficient manner 10 provide additional stomlwater servicing, where
required, within established and future development areas of the community..
When completed, the Mttster Plan will recommend a storntwater servicing strategy that could Iw
implemented in phases within the established areas of Bayfield, as well as recommending best
practices and strategies for addressing stonmwater servicing within future development areas of the
community.

The investigation is being planned as a Master Plan project under the Municipal C'Iass
Environmental Assessment document. Master Plan projects incorporate a screening process that
involves consultation with the public, government review agencies and affected property owners.
Public input and comment are therefore invited for incorporation into the project.
PUBLIC INVOLVEMENT:
The consultation program fur this Class EA Master Plan process includes several opportunities for
public involvement including a questionnaire and public information meeting. Details related to the
public meeting will he provided at a later date. For the initial phase of the program, public input into
the planning and design of this project will be received until September 20, 2013. Additional
opportunities for comment will he provided as the process proceeds. Any comments collected in
conjunction with this Class FA will be maintained on tile for use during the project and may he
included in project documentation. With the exception of personal information, all connnents will
become part of the public record

Mr. Paulger expressed concern

Jim Davies, Paulger partner, is nuw
requesting that Council pro -rate the
rental fee and that no cash -in -lieu of
parking for the patio be charged.
At the August 1st sleeting, Bones-
teel said he had no problem with the
liquor license issue or the encroach-
ment agreement. lie wants the rental
fee pro -rated because the summer is
almost over and does not want the
cash In lieu fee because it was coun-
cil's idea to put the moratorium on
this patio and if they had not done
that- J -Dees would not have had to
pay a fee. Councilor Dave Maguire
disagreed saying this was their policy
and it should be followed. "If we are
renting space cash in lieu mus'
applied," he said. -

Martin Underwood, "We are looking
for one person, one exemption." ole
said he understood Bonesteel's logic
but wondered if they would be
amending fees for everyone. "This is
not an exemption; explained Bones-
teel- this is a resumption. They are
resuming the business they already
had. This 1s not a new request."
Mayor 13i11 Weber asked if this was an
assumption of the old policy or the
newly adopted policy that had just
been passed a month ago. In a
recorded vote to waive the fees Bon-
t'stl'eI, 1.orie Scott, Ken MCKI'ea and
Underwood voted yes.
