Another kick at the can for J -Dees patio request

Although Lambton Shores council mem-
ber Louie Scott told council they should bite
the bullet and take the moratorium off side
walk cafes, J- Dees in (;rand Bend will have
to wait a couple more weeks to find out If that
w1I1 happen,
At the June 20, meeting, Jim Davies of JI)'s
Summerhouse asked for three tables on the
sidewalk In front of the existing restaurant,
For manly years, sidewalk cafets were part
Of the (rand Bend Streetscape; however, per-
mission to use the sidewalks for commercial
operations was discontinued when the Main
Street enhancements were undertaken in
2009.
In '2010, a moratorium was enacted on
retail operations on the municipal sidewalk
in order to review the effectiveness of the
new sidewalk design and evaluate what
Impact sidewalk caftts or other commercial
operations would have on the sidewalk, and
it wits discussed that if cafes were to be per-
mitted In the future, It would he beneficial for
the municipality to establish design guide-
lines criteria for the caftts to ensure compati-
bly with the new "streetscape" elements.
•1 he moratorium was reviewed In 2011, and
council decided that the existing moratorium
and prohibition of commercial use of (rand
Bend Main Street be confirmed and that the
issue of sidewalk cafes be referred to the Stra-
tegic Plan discussions for further review.
The issue was again discussed in July of
2012, and a proposed motion to reconsider
the moratorium was withdrawn, and the
minutes of the sleeting noted "Discussion
ensued on the passed Council decisions per-
taining to sidewalk caf cs, and that a decision
such as this should have public consultation
with Council agreeing that this matter should
be referred to Strategic Pian discussions. At
the most recent Council sleeting, the issues
referred previously to the Strategic Planning
discussion were reviewed, and the recom-
mendation with respect to the above noted
resolution from 2011 was that it be referred
to the Official Plan discussions, due to the
land use implications.
Council asked for reconsideration so the
matter could be discussed at last week's
meeting and in discussions councilor Martin
t)nderwood asked if they were allowing the
moratorium lifted- did that mean everyone
in Lambton Shores had the stern(' rules. Scott
said it was already the end of June they
should just let them go ahead. Deputy mayor
Elizabeth Davis- Dagg said although Davies
presented a positive presentation, she was
not sure everyone's perception of the pro-
posed barrier was the same, She said there
needed to be restrictions put in place and
Davies explained they had to have a barrier
under the AGCO laws. Councilor Doug Cook
asked about cash in lieu since It was munici-
paI land being used. Councilor Doug Bones-
teel said Bayfield is dying and there needs to
be a reason for people to conte to (rand
Bend and that outdoor patios would be a
good reason. Councilor John Russell said
they need a report for the next meeting that
can get them to a "yes we can" place. Scott
said this should be a test pilot and at the end
of the summer they could evaluate In Sep-
tember to see if there could be exemptions
for all of Lambton Shores. Davis Dagg said
there is a distinct difference between Forest
and (;rand Bend and they should not be "fool
hardy" making the decision. She too thought
there should be a report from staff. Scott said
they could use the salve structure there is in
Forest and McKenzie said they have a
1 5 -page agreement that has been followed in
the past.
Council agreed to have staff bring back a
report to the next meeting.
Procedural by-law comes back to Lambton Shores for review

'The procedural by-law came back to Lambton
Shores council last week In an attempt to make
changes that were deemed needed. 111 a report
from clerk Carol McKenzie explaining that the role
of a procedural by-Iaw is to allow council to
accomplish its work In a logical, fair and efficient
manner.
She told council that during previous discus-
sions, it was noted that the Lambton Shores Proce-
dural By-law needed to be updated, not only to
revise the information re: meeting tinges and the
order of agendas items, but also to ensure that the
by-law contained the current municipal require-
ments and to ensure that the rules of procedure
were clearly stated.
The changes to the by-law that have been dis-
cussed at previous meetings or recommended by
staff and were noted in a thorough report from the
clerk with the rationale for each recommended
change.
As an additional objective opinion, a copy of the
by-law was provided to consultant Nigel Bell -
chamber for review, and he provided suggestions
based on his extensive experience. The changes
were also noted In McKenzie's 30 plus page report

ommended the policy that looked at

amended in accordance and that the
draft policies of processing Delegation
Requests and Requests for Municipal
information be approved. Deputy
mayor Elizabeth Davis Dagg asked that
they go through each of the points, ono
by one, within the 30 pages and
councilor John Russell thought it was a
good report and if there were issues
along the way, they could bring them
back to the table. Davis-Dagg said that
was "unbelievable" that council did not
want to go through each of the points.
Both her and councilor Lorie Scott
voted no to the motion to go forward

Grand Bend businesses get
warning about loud music

'I'he Grand Bend Chamber of Com-
merce has sent out at notification to Main
Street businesses regarding loud music.
"We received notification from the
Municipality that several businesses on
Main Street West, Grand Bend were
playing music loudly and on the street
and that this is a Noise Bylaw infraction;"
explained Chamber manager Susan
Mills. Lambton Shores clerk Carol Mac-
Kenzie told the Lakeshore Advance they
have received complaints from the
downtown.
Mills stated the concern is not about
businesses playing music inside their
location and which have speakers facing
inwards, this concerns music specifically
aimed outwards to the street or being
played on the street itself.
She offered information to the busi-
nesses as a general reminder stating,
"here's the snippet of the Noise Bylaw
that covers this issue,"

created by any radio, phonograph, pub-
lic address system, sound equipment,
loud speaker, or similar device or
devices, or any musical or sound pro-
ducing instrument or whatever kind,
when such device or instrument is
played or operated in such a manner or
with such volume: (a) As to likely annoy
or disturb the peace, quiet, comfort of
repose of any individual in any type of
residence; or (b) In the rase of a device
or Instrument located in any commer-
cial building or structure, as to be plainly
audible upon the public streets at a dis-
tance of 8 metres (25 feet) from the
building or structure in which such
device or instrument is located:
"We're told for now warnings were
issued, but that tickets would be written
to those businesses who contintle to ere •
ate a noise infraction.
Buskerfest, the Chamber applied and
received special permission for musical
huskers to "husk" openly on Main Street,
the Main Beach area and River Road as
well as on participating Member busi-
ness locations - so last weekend's
upcoming event was addressed.
