comments heat up meeting

Lakeshore Advance
The north sewer adhoc meeting became
heated last week as a member of the gallery
asked for an in camera session regarding a
legal issue.
The Lakeshore Advance was informed the
committee will seek a legal opinion on the
assertions.
The adhoc group was formed after mem-
bers of the community voiced their concern
regarding a lack of answers when it came to
a collection system from Southcott Pines to
the Ausable Cut. The ad hoc committee is
subject to the control and direction of the
council. In their terms of reference it states,
"The Committee will review the issue
pertaining to the extension of waste water
services to the residents and businesses of
Zone 3 and 4, as identified in the Munici-
palities of Lambton Shores, Bluewater and
South Huron Grand Bend and Area Sanitary
Sewage Servicing Master Plan"
Council appointed the committee
composed of residents and members of
Council to study the issue of sanitary sewer
services.
The committee was split into five groups
that would investigate; need for improved
sanitary sewage treatment, cost/benefit of
the sewer treatment facility, and collection
system, future options of sewage treatment,
taxation and user fee issues and communi-
cation with taxpayers.

updates from the five groups were
discussed and will be detailed at a future
public meeting. It was during discussion
period where the meeting became
heated.
Gerry Rupke, a former Lambton Shores
councillor and a registered professional
engineer, addressed council and reported
his qualifications include a (P Eng.) Bach-
elor's degree in Chemical engineering
from the University of Waterloo and a
Master's degree in Environmental health
Engineering from the University of Texas
in Austin, Texas. Ile told the committee
this was his first opportunity to attend
a meeting. Ills questions led to Deputy
Mayor Elizabeth Davis Dagg suggesting he
was attacking their value.
Rupke first asked if anyone on the com-
mittee has looked at the Ontario govern-
ment's Technical Guideline for Individual
on-site Sewage Systems: Water Quality
Impact Risk Assessment. After a
pause, committee chairman Carl Belke
said he had not heard of it. Rupke
explained this was the Ministry of Envi-
ronment's "bible." Belke said they have
been trying unsuccessfully to meet with
the Ministry of Environment (MOE).
Rupke read from the MOE document
and highlighted the ruling that while one
can contaminate the water that falls from
the sky onto your lot, one cannot contami-
nate the water that is under the ground.
"You talk in your reports about concen-
tration but that is meaningless. All the
Ministry cares about is: are you using
more than your share. clow much water
you contribute - how much nitrate you
contribute and that's all - no other
questions."
Ile offered to leave the document with
this body.
Rupke's Three Questions
Rupke then asked about this group's
terms of reference inquiring as to why
they were doing the work the consultant
already did.
"Why was this committee formed?" he
asked, suggesting Dillon already did the
work. Ne asked why there was not a peer
review to which Deputy Mayor Elizabeth
Davis Dagg suggested that was something
the last council could have done.
"The last council did not see a need for
a review," said Rupke.
Davis Dagg said the reason for the
committee was due to the "serious misun-
derstandings that have arisen in this com-
munity." She said the misunderstandings
were a result of things in Dillon's work.
Davis Dagg said they want to come back
with answers. She then accused Rupke of
attacking this group, insinuating there was
no value to their existence. Rupke said he
was merely seeking answers.
Rupke then asked if this group was
planning on evaluating options to provide
sewage treatment systems to Grand Bend.
"Does this committee plan to evaluate
options - for sewage treatment to Grand
Bend?" Belke said "yes" and Davis Dagg
said "absolutely" Rupke asked if they will
advise council on how to proceed. Belke
said a report of these findings will go hack
to'counc:il.
"If this is the case, 1 would like to
address council in camera," Rupke said,
Davis Dagg asked if this was a legal issue
to which Rupke said yes. Davis Dagg said
she did not feel that this was their (thi
committee) responsibility to deal will.

committee member Ernie Lewis. "With
yourself? With Professional Engineer's
Association Let's just say it is a legal issue.
If you wish I can elaborate - and then it
won't be in camera," Rupke responded.
Sonie members of the committee sug-
gested it was not the body to deal with
legal matters. In a point of order from the
gallery, resident Bob Sharen said since the
group is a committee of council, the
same procedural rules apply and this was
verified by CA(.) John Byrne.

Not deterred by their indecision as to
whether they should go behind closed
doors, Rupke said if they wished, he could
elaborate and keep on talking without
going into at closed session,
Committee vice-chairman Richai
Faber said Rupke had some interesting"
questions."
"You asked the committee if they were
going to evaluate different treatment
options," said Faber. "No we are not going
to evaluate - we are not engineers. We are
going to recommend to council for them
to consider options - that's a little
different. We are not pretending to he
engineers - we are getting options and
giving council advice, We are not evaluat-
ing technical systems"
Again Rupke suggested they go in
camera. "If you don't wish that I will speak
now," he offered,
The committee chose to hold an in
camera session it later reported to the
Lakeshore Advance that legal advice
would be sought on Rupke's assertions.
