Residents oppose council's contribution to new subdivision

Two letters from Seaforth residents
concerned about the municipality's
$125,000 contribution to a local de-
veloper to pay for the construction of
Robert Street in a new subdivision
at the former Seaforth Public School
were tabled by Huron East council at
its Oct. 20 meeting.
The letters, from Don
Pletsch and Barbara Box, were in-
cluded in the councillors' agenda
packages.
"I read the correspondence and I
respect and understand their con-
cerns but I think we should table it
until we have had proper legal ad-

"They (municipal lawyers) have to
look at the development agreement
and all that type of stuff," said Seili.
Brussels Coun. David Blaney asked
if raising the question about the
$125,000 contribution_ would mean
the development agreement would
be opened up again.
"I was just wondering how big the
kettle of fish is we're opening. A legal
opinion would be really good at this
point," he said.
John. Lansink, one of the pro-
posed subdivision's neighbours who
appealed the subdivision's zoning
amendment, asked council that he
and his neighbours be notified when
the issue comes up again at council.
"We were under the impression
you'd seek legal counsel at the last
meeting. I think it's cut and dried,
personally," he said.
The letter from Barbara Box ex-
presses her "strong opposition" to
council _ `:sing the Seaforth reserve
fund towards the construction of the
street in the development.
"The condition was that the school
building be demolished and the prop-
erty be cleared of debris within one
year. March 2008 arrived *and the
property was not cleared," said the
letter.

"Surely, this repeated non-compli-
ance with the agreement would have
made the agreement null and void at
the end of 2008," it said.
The letter from Don and Kathy
Pletsch contains the same opinion.
"As the original conditions have
not been met and the company to
which the money was pledged is not
named as the owner of the property
of the developer, we believe the town
has little choice but to withhold the
money," said the letter from the
Pletschs.
Box, who was in attendance at the
meeting, asked council why the deci-
sion was made in the first place to
"gift this developer to open a road"
when she said no other developers
in Seaforth received the same treat-
ment.
Clerk -Administrator Jack
McLachlan told her the issue couldn't
be discussed yet.
"It isn't fair to answer that until we
get a legal opinion," he said.
"if you find out you might be sued,

Seili responded he couldn't answer
that question either.
"I can't guess what these guys will
do all the time," he said of council's
actions.
