Land ripped up, 1,000 trees destroyed by trespassers
From Page 1
Gene says that while people
.tre

Yuisceu Vv_c_Y tLc land still had a
gravel pit, the slope was so steep that
it was only daredevils that made the
attempt.
Now that the slopes are less dan-
gerous, it seems like more people
have decided to use it as a recre-
ational trail, even taking their kids
on the private property on ATVs.
She says last week, her son came
across two men . riding ATVs with
five-year-old kids on the back. When
he told them they were riding on pri-
vate property, they questioned his
authority to kick them off the land.
"We thought it would be kids doing
the trespassing but there are appar-
ently adults who don't think that the
rules apply to them either, and es-
pecially with regard to taking their
children on an ATV," she says.
Gene says she can't believe people
would buy ATVs and snowmobiles
when they have nowhere else to ride
them but on someone else's proper-
ty.
• "People should figure it out. If they
don't have permission, they shouldn't
go on private property," she says.
"With the increased use of snow-
mobiles and ATVs, it is getting very
tiring to have to be greeted by people
making trails, killing trees and dam-
aging anything that gets in their
way, every single sunny day."
Raising miniature horses on their
farm, the Baynhams say they could
never pasture their horses at the
back of the farm because of all the -
tresuassing.
"If we pastured horses back there,
they'd be a mess. They don't like the
noise and that land wouldn't be safe
for them," says Gene.
The Baynhams have increased
theirefforts to prevent trespassing
since hearing about a case in North-
. ern Ontario where a gravel pit own-
er was found liable after some kids
trespassed on the property, dttg some
caves in the hills and died when the
caves collapsed on them.
"The landowner was sued for mil-
lions, for everything he had. We're
trying to prevent disaster - we would
not be happy to know someone died
or broke a leg on our property," she
says.
Gene says she's afraid to walk on
her own property since when she
was walking the. ridge of the second
gravel pit north of -Highway 8 recent-
ly, an ATV came flying over the ridge
and over ht'r head.
"You take your life in your hands,"
she says.
She's also worried about the fact
that people have made themselves
at home in the bush on her property,
holding bush parties, lighting bon-
fires and building forts.
"There's a lot of dried needles and
brush in there that could go up just
like gasoline. If a fire took off, there
could be fatalities," she says.
While they used to ask the police
to patrol the area and watch for tres-

passers, they have never laid any
charges against anyone for trespass-
ing.
"Ninety per cent of the time, people
are polite and they don't come back
when you tell them it's private prop-
erty. But, if someone was back there
all the time, I'd be calling the police,"
she says.
She adds that she and her husband
would never give anyone permission
to ride their ATVs or snowmobiles on
the property.
"We want to make it known that
this is private property. But, the - dif-
ficulty is this land is too handy to
town" she says:
Gene is resigned that all her efforts
to prevent trespassing will likely be
unsuccessful but she's hoping that
at least if disaster does happen, her
liability will be decreased by the
lengths she and her husband are go-
ing to inform the public to -stay off
the property,
"It would be nice if it stopped but
I'm sure it won't, especially with
summer corning up," she says.
