Stienburg questions judicial system of the time

the state. Over time, that concern
waned and Stienburg found himself
picking up the phone.
Truscott approached the
Association in Defence of the
Wrongfully Convicted (AIDWYC) in
1997, as he was hopeful the strides
made in DNA analysis would result
in his exoneration. That hope
proved futile when it was learned
Lynne's DNA evidence had been
destroyed.
In the year 2000, the public's
attention was again drawn to the
case when CBC TV's Fifth Estate
investigative -journalism show
agreed to pursue the matter.
That move, says Stienburg, came
only after the Truscotts knew their
children, Devon, Ryan and Lesley,
were old enough to understand the
particulars of the case. Ironically,
notes Stienburg, at least one of the
Truscott children had studied the
case in class.
CBC reporter Julian Sher's book,
Until You Are Dead, drew even
more public attention. The fact Sher
found some evidence never intro-
duced at trial "shakes the criminal -
justice system right down to the toe-
nails," says Stienburg.
Stienburg has never doubted
Truscott's innocence.
Instead, Stienburg questions the
judicial process of the time, espe-
cially the notion that a fair trial
could have been possible with an
impartial jury given the charged
atmosphere following the rape and

strangulation murder of Lynne,
who, along with Truscott, called
home the air -force base, now known
as Vanastra.
Stienburg is also critical of some
of those connected to the case,
including the lead officer, the late
Insp. Harold Graham.
"He built a career on this case,"
says Stienburg, who is more forgiv-
ing of the original pathologist, the
late Dr. John Penistan, whose find-
ings loomed large in the conviction
of Truscott.
Today, says Stienburg, it is the
human -interest stories connected
with the Truscott saga that deserve
consideration. One story that sticks
with him is of Truscott's brother
climbing a tree beside the Goderich
jail so the two could speak.

Stienburg also recalls what
Truscott said when he found out his
execution had been stayed.
"He said he went outside and
threw snowballs against the court
house wall."
There is also compassion for
Steven and Marlene.
"How they got together and
stayed together," says Stienburg in
wonderment.
And, though Stienburg is sure of
Truscott's- innocence, he is not so
confident the Ontario Court of
Appeal will overturn a conviction he
believes is wrong.
"What's on trial now is our justice
system and whether it's strong
enough to admit it made a mistake
in 1959," he says. "I don't think it
is."
