OMB in favour
of zoning bylaw
amendment

It took an Ontario
Municipal Board (OMB)
chair less than two hours to
rule in favour of a zoning
bylaw amendment for a
Dublin business.
On Dec. 3, the OMB
ruled that an application to
change the zoning of
Cronin Contracting, owned
by Joan Cronin for her son
Darrel's contracting
business, could proceed
from the existing future
development to light
industrial, and allow for
future expansion at their
location on John Street.
In order for that to
happen, though, a site plan
would still have to be
approved by West Perth
council.
This verbal OMB ruling
allows the proposal to
move to the next step.
• West Perth municipal
council originally ruled last
March that the existing and
future use of the business,
currently used for a
warehouse, and a proposed
60 -ft. x 90 -ft. building, was
not a good fit, siding with
neighbours , who
complained abut the
amount of garbage, noise
pollution and safety
concerns at the business
location.
"We're happy with the
result, obviously," said
Barry Card, of London,
who acted as solicitor for
the Cronins in their legal
fight. "It's too bad it took so
long."
A petition of 24 residents
of Raglan and John Streets
in Dublin was presented to
council last March, asking
that the zoning amendment
and the proposed expansion
not proceed.
Most of the neighbours'
complaints were to be
addressed with a revised
site plan and a contained
structure at the location,
council was told at the
time, but still council chose
to refuse it, ignoring advice
from their planner, Mark
Swallow, and their planning
advisory committee.
In an ironic twist,
Swallow was subpoenaed to
provide evidence against
the municipality in the case.
Card said the use of the
property was the first issue
of contention, and the OMB
decision "clears that up"
and paves the way for the
building's construction.
"It's not going to happen
instantly. anyway," he said,
referring to the building.
Hiring a solicitor, Mike
Mitchell, to represent their
side was not unanimous ,by
council in September when
they discovered that the
issue would indeed go to
the OMB.
