SEIU workers fight to reinstate 19 laid off in `93

Protesting Huronview and
Huronlea workers in the
Service Employees
International Union (SEIU)
Local 210 met county
councillors going into their
monthly meeting on Sept. 6.
They were also handing out
information bulletins as part
of their protest, saying that
after eight years of legal
battles all the way to the
Supreme Court of Canada
they are still being told by the
county that they do not have
the right to have full-time jobs
reinstated as the result of
winning an arbitration award.
"We are tired of these
delays for what we rightfully
won and for actions which
suggest the courts have no
enforcement powers. Workers
fight continually for their
rights, they have avenues to
do this and they must be
recognized if successful," said
Cathy Carroll, Local 210
representative in a press
release.

Coun. Deb Shewfelt,
Goderich, broached the
subject of the protest outside
during open question period
at council.
"I find it strange that we
can't bring this to a
conclusion," said Shewfelt,
referring to his experience
with policing negotiations.
Warden Norm Fairles,
Howick, said the negotiation
team feels that they are close
to getting the matter resolved
in another month. The union
however, has a court date set
for Sept. 28, to go before the
courts and ask for a judge to
enforce the ruling. If the
county doesn't abide then
they can be held in contempt
of court, said Carroll.
Nineteen workers from
Huronview were laid off in
1993. The union fought the
dismissals of the workers
because they said there were
no cuts in the number of beds
in the facility and no reason to
cut the workers.
"It's totally unacceptable,
we're won the arbitration and
if they can't abide it we will
be taking further action
through the courts on Sept.
28," said Carroll outside of
county council. The union
will be going in front of the
judge to get him to enforce
the arbitration ruling. If the
county doesn't comply then
they will be in contempt of
court.
"The union has spent a lot
of money and time getting
here. The language in the
collective agreement
(between the county and the
Huronview/Huronlea
workers) is unique that it
protects both jobs and also the
residents," said Carroll. She
said usually a layoff follows
after a decrease in the number
of beds in a facility, however,
at both homes there has been
no decrease in the number of
residents and fewer workers.
When the county councillors
came Carroll said they were
asking them if they could get
a resident ready in 12 minutes
for breakfast in the morning
to brush their teeth, get their
clothes on and wash up.
"To me this is not adequate
care," she said. "The county is
still responsible to those
homes."
If the county increased their
funding back to 1996 levels at
the county, they could fund
every one of those jobs that
they laid off before, said
Carroll.
Fixing steps
to Hensall
Library
a tough job
A quest to fix the steps
leading to the Hensall
branch library is turning
out to be a tough
assignment.
Dickens has contacted
area contractors a
second time but has
been told they're too
busy, with one
estimating the work
could be done in
November.
Dickens said if council
decided to repair the
steps, the project cost
would escalate because
of the need to heat and
cover the work in
progress.
He suggested council
put the project on hold
until next spring and use
a side entrance (that
lead to the former
Hensall municipal
office) until the front
steps are repaired.
