Lebeau could not
have been the driver

Sarah LeBeau could not
have been the driver of her
1995 Camaro when it crashed
off County Road 31 killing
four youths, the accused's
lawyer stated during closing
arguments.
Closing arguments began
last Monday in the trial which
began last September. -LeBeau
faces 11 charges, including
four counts of impaired driving
causing death, four counts of
criminal negligence causing
death, one count of impaired.
driving causing bodily harm,
criminal negligence causing
bodily harm, and driving over
the legal limit.
The crash occurred on Nov.
24, 1996, after the LeBeau car.
left a parry in Varna. Killed in
the crash were Neal Atchison
and Pamela King of Clinton,
and Brian Hill and Mark
Webster of Stanley Township.
Both LeBeau and; Brandon
Gardner, of Vanastra, were
seriously injured in the crash.

Johns was appointed to the
provincial/cabinet last week as
the province's. new Minister of
Citizenship, Culture and
. Recreation, Seniors' Issues,'and
Women's Issues.- J
J- J9hns was sworn into her
new position at a special
ceremony held at Queen's Park
- in Toronto on June 17.
In , a recent telephone
interview, Johns said she was
"extremely pleased" with the
appointment and added that this
shows Premier Mike Harris hal
"confidence in my abilities."
Johns also said her new
appointment. gives her a
position at the Cabinet ttable, '
where she can bring a"wide,
variety of issues" concerning
her Huron Bmce constituents to
' the attentionof the other
Cabinet members. •
The ministry Johns is
----- ----responsible _for is a new
ministry amalgamated from
three different areas, she said.
In working with both the
Seniors' and Women's
Secretariat, Johns will be
concerned with such issues that
deal with the health, safety and
needs of both of these groups.
Through citizenship, culture
and .recreation, Johns'
responsibilities include ensuring
that citizens are "treated fairly
and equitably" as- well as
encouraging the arts and
cultural industries throughout
the province, and promoting
sport, recreation and physical
activity. ,
Johns said that her
appointment is especially
"exciting" since she is the first
MPP from a rural riding in a
long time to be named the head
of this ministry.
"I am looking forward to my
new responsibilities; and see_
this as a great opportunity to
build on the foundations laid by
the Mike Harris government in
our first mandate," said Johns in
a recent press release.
Since Johns was first elected
in 1995, she has served as
Parliamentary,Assistant in the
Health, and Energy. Science
and Technology portfolios. She.
has extensive experience in
business, which she said will
help her in her new role as
minister.

appointments, Ernie Hardeman,
MPP of Oxford, is the new
Minister of Agriculture. Food
and Rural Affairs; Janet Ecker,
who was raised in Exeter. Ont.,
is the Minister of Education;
Elizabeth Witmer. who was
also raised in Exeter, remains
the Minister of Health and
Long -Term Care; John Baird
was named Minister of
Community and Social
Services; and James Gilchrist
was named Minister of
Municipal Affairs and Housing.

said LeBeau did not have to
take the stand in her defence
but felt a lot of people needed
to know from her what
happened.
Carey explained that
LeBeau's memory recalls of
the accident are "episodic" and
described them as looking at
pictures running through her
mind.
"Memory doesn't always
come back in a tidy order,' said
Carey. .
He added that if LeBeau had
fabricated a story of that night,
why would she not say "I
remember Neal driving."
Carey said - there is no
question LeBeau was in the;
driver's seat when they were
leaving the Hill residence.

moved onto the console and
feeling the car driving away.
LeBeau's driving record had
been earlier presented to the
court, but Carey said that her
record does.not indicate she
was a fast driver or that she
would ever drive the 150
km/hr. the car was believed to
be travelling at the time of the:
accident. - •
LeBeau'had been given two
recorded speeding tickets for
driving 65 in a 50 zone.
"This hardly represents a
high speed of driving," said
Carey, Later adding that the fact
of speed points away from
LeBeau being the driver.
Carey said that evidence
given in court of Atchison's
driving. "the light points at
him" being, more capable of
driving at such high speeds.
Witnesses in the trial have said.
that Atchison liked to drive
fast to show off his car and
once played chicken with an
oncoming vehicle.
Carey stated before the court
that he had a "huge difficulty
with the. Crown theory" that
LeBeau's injuries were
consistent with her being the
driver.
He said the Crown assumes
that the major -impact of the
crash happened when the car
hit the first embankment and
that this impact caused the
major intrusion into the
driver's footw-ell therefore
"locking in" lower extremity
injuries for the driver of this
vehicle.
LeBeau sustained severe
lower extremity injuries, but
Carey said several witnesses
testified that since the vehicle
was ` involved in multiple
-impacts, a roll over and alt
occupants -were unbelted, it's
difficult to pinpoint . the
location of anyone in. the
vehicle. •
-Carey also pointed out that
lower extremity injuries could
have been missed on Atchison
when he was examined by a
pathologist, since , lower
extremityinjuries' had been
missed on some of the other
Occupant..
• Two deposits of blood found
on the ,airbag were not
LeBeau's, said Carey.
Testimony ' showed that
LeBeau had been bleeding
from her face and hands and
.added that one would expect
blood to be found on the bag
from her if she was the driver.
