McClcnaghansaid she couldn't remember what she was drinking at the Hill party or how much. She testified that she wasn't sure who's beer was found in LeBeau's vehicle at the scene of the accident.. said she can't remember if LeBeau was drinking. "Arc =you trying to protect your friend:'," asked Morris, questioning McClcnaghan's "spotty memory...Did you have more to drink than you're telling usr McClcnaghan said that was • not the case and added that she never noticed anything "out of the -ordinary with- LeBcau's behaviour. . "If she was (acting) out of the ordinary 1 would .have noticed." said McClcnaghan. Chris Ciapka was on his way to Goderich from London to go fishing in the early hours of Nov. 24, 1996, when he and his friend came across the accident. Ciapka testified Tuesday that they came across a male in the middle of County Road 31 trying to flag them down. He said they pulled over, heard there had been and .accident and went to help. Ciapka said he was the first one to find the vehicle and said thc female on the scene became hysterical- when she found her friends at,the scene of the accident. - He went close to the vehicle and given his training as a ,volunteer firefighter, began to check for vital signs and any gas leaks from the ear that could cause more danger. Ciapka'said at the scene he found two bodies outside the car and three inside. He testified that he found one female outside near the front of the driver's wheel lying parallel to the vehicle. Hc added that her body was completely out of the vehicle. A larger male. he said, -was found towards the back of the car, lying perpendicular to the car. He added that these two. occupantswere alive. Three people were found inside, one male sitting in the driver's scat with his legs down by the pedals, one person in the passenger scat leaning on the dash anti ohe person in the back seat almost "rolled in a hall" All three of these occupants were mule. Once all of the occupants were checked he ran to his truck to get blankets to lay on the passengers and then began clearing a way for the ambulance attendants to get down the hill to the vehicle. Ciapka said he could smell alcohol both around the car and from the female (McClcnaghan) at the scene. Through cross examination. - Morris asked Ciapka about a statement he gave to a private investigator more that six months 'after the accident. In his statement, he said McClcnaghan had told him at the scene that the LeBeau vehicle left thc party at a high speed and a male at the scene asked Ciapka to tell the police he had been driving his car because the male had been drinking to much. . "I told him I wouldn't do it," said Ciapka. C)osing arguments began Monday and were expected ti► finish today, (June 16) Flower racks dumped in parking - lot Minimal damage was done to flower racks in the parking lot at'thc Knechtcl Food Stotre in Seaforth overnight on June 12. says the Huron OPP -. Metal racks full of flowers were pushed over sometime in the night. The rack's were undamaged but minor repair was -necessary = to the flowers, which had to he picked up.
