LeBeau does not believe.
she was behind the wheel

Sarah LeBeau does not
believe she was driving,the
vehicle when it left County
Road 31 near Varna and
crashed killing four people.
LeBeau took the stand in
her defence last Tuesday
claiming that. she would
never have driven -as fast as
the police. claim the vehicle
was driving - in excess of
ISO km. •
"I don't think I would ever
drive that fast," said LeBeau.
The 22 -year-old
Brucefield woman faces 11
charges relating to the Nov.
24. 1996 accident that killed
Neal.Atchison and Pamela
King of Clinton, and Brian
Hill and Mark Webster of
Stanley Township. LeBeau
and Brandon Gardner of
Vanastra were both seriously
injured in the crash.
LeBeau has pleaded not
guilty to four counts of
criminal negligence causing
death. criminal negligence
causing bodily harm. four
counts of impaired driving
causing death. impaired
driving causing bodily harm.
and driving over the legal
limit.
LeBeau suffered extensive
injurie=s from the accident,'
and testified that she spent
more than 90 days'in the
hospital after the accident.
The 'car involved in the
accident was leased"by
'LeBeau in June 1,995. 'She
testified that she liked the
look of the car and that
power wasn't a deciding'
factor when she chose it.
Before the accident, she
said that she had been given
a speeding ticket for driving
105 km/hrin an 80 zone.
'County Road 31 was a
familiar road to LeBeau. She
said she lives about five
miles from the' road and
when she drove north from
Varna. took the downward
curve towards the Bayfield
River with caution. slowing
down to about 70-80 kin/hr.
She also testified that it
was not uncommon lor her
let- her friends or family
drive her car. ' •
"I was proud of my car
and I wanted somebody else
to like it too." .she testified
before Defence lawyer Glen
Carey'.' Site' testified that
King and Gardner had
driven her car before but
Atchison never had. She
added that he often asked
her'if he could drive it but
was never in a• situation
where he could.
She said it was her custom
that if she had been drinking.
they would either stay over
night where they were.'get a
ride with someone else or
have someone else drive.
LeBeau des'iribed herself
as a social drinker and added
that she sometimes became
intoxicated.
"On those occasions I
wouldn't drive," she said.
LeBeau also testified that
she had previous problems
with her car. She said that
while driving in the United
States. she drove through a
stop sign because her brakes
wouldn't work. She stopped
for assistance and found that
they suddenly did work. Her
father took it to the dealer in
Goderich to have it repaired
and he had similar problems
with no brakes but upon
examination from a
mechanic, they suddenly
worked again.
Because of the accident.
LeBeau said that her
memory is still a little
"foggy". She said she had
amnesia after the accident
and now memories come
back to her in "little bits
here and there."

LeBeau testified that she.
remembers getting ready for
'the party and ,picking up
'friends to gorto the party and
that she was late getting
there. She said that when
they arrived at the party She
remembers feeling "sober".
She said that she remembers
going to the bathroom with
King and making up with
her for an argument they had
had and that the pair later
went' with Atchison and Tim
Gerrits to Gerrits':house.
When they left the party.
LeBeau said there was a lot
of people talking around the
cars and getting•,into the
cars. She said she
remembers leaving the Hill's
driveway but can't
remember what position she
was sitting in the car. Then
she said she remembers her
car stopping. she leaned over
on Hill. had her legs in the
driver's area and Atchison
.got into the driver's seat.
Her last memory is of
turning around to talk to
King from the console and
knowing that Hill was in the
passenger seat. Atchison was --
in the driver's seat and King
behind the driver's seat.
"The next thing I recall ig
being in the hospital,- she
said.
In cross examination by
Crown Attorney Bob Morris.
LeBeau testified that she
remembers one of two other
speeding tickets. One ticket
was given in Goderich.in
November 1994 'for
travelling 65 km/hr. in a 50
zone. She said she doesn't
remember another speeding
ticket given in Goderich in
November 1995 for
travelling 65 in a 50 zone.
She. also testified that she
doesn't remember receiving
a ticket in London for not
wearing a seat belt.
Morris also questioned
LeBeau about a 52.5 Million.
lawsuit against Huron
County for the state of
County Road 31, but LeBeau
said it was filed from her
lawyer and she knew very
few details about the suit.
The Crown wrapped up its
case Monday with evidence
from the Centre of Forensic
Science.
Keith Kelder, a forensic
biologist from the centre.
tested the driver and
passenger air bag from the
LeBeau vehicle for blood
and saliva. Kelder had
received blood samples from
LeBeau. King's parents.
Hill's parents, Webster's
parents., as well as tissue
samples from Atchison.
Saliva found on the
driver's air bag was female
in origin and matched
LeBgau's DNA. Kelder
testified that the biological
daughter of the King's was
excluded as the source of .the
saliva. ` , .
, The DNA 'profile from the
passenger air bag, male in
• gender, was from the
biological son of the' Hills..
The profile did not match
Atchison or Webster.
Blood found . on -.clic
driver's air bag comes from
a male but did not come
from Atchison, Hill or
Webster.
No Comparison sample
was done from Gardner. It
• was later stated that he
refused giving a sample.'
Last Wednesday, the court
heard testimony from a
chemist from the CFS and an
' engineer from the University
of Western Ontario.
Brenda Burton examined'
the air bag from LeBgau's
car and was asked
specifically to examine
black and pink. colorations
found oh the air bag. . •
Burton testified .that -the
black marks fotind in
' "striation's" on the• air bag - ,
contained similar chemical'
elements found in mascara.
Two pink marks found
around the •black marks
contained similar elements
as eye shadows and a pink
mark found below the black
marks. contained similar
elements to face powder.
"Based on my analysis. I
couldn't say these were not
cosmetic, materials. said
Burton, adding that she•
tested a number of different
make -ups to compare what
was found on the air bag.
Kevin McClafferty. from
the University of Western
Ontario, is an engineer who
performs accident research.
Testifying about airbag
deployment, he said that an
impact atd15-20 km/hr. will
trigger an air bag to go off.
The bag comes out at about
300 km/hr:. and .is fully
inflated within '10-20-
milliseconds.
In his research. he said
that a belted driver will hit
the bag -with. their face and
chest and- may -contact their'
lower legs with the "knee
bolster'..•

top of the bag and contact
the windshielli header and
has more severe contact with.

extremity injuries."
McClafferty also testified
that the transferring .of
bodily tluidS onto the bag is
expected. especially from
the driver. He .added that.
with female drivers. makeup
transfers onto the bag like a
"stamp„ .
"Makeup is good evidence
Of occupant contact." he
said. "Blood is not as good
because. there are various
ways they can.occur."
`In cross examination:-
McClafferty said it is more
diff cult- to predict driver
injuries with unbelted
occupants in a• multiple
impact•crash and added that
with unbelted occupants they
can move anywhere in the
car.
