Justice Donnelly said "the

they saw Mistic leave with
Steve on May 31.
Donnelly' reviewed the tes-
timony of witnesses who said
they saw Mistie after May
31.

believe any one of those
sightings could be accepted
beyond a reasonable doubt,
they had to to find Murray

"The fact no body has been
found is an important factor
in determining she • is dead."

risk that an honest. conscien-
tious witness could be mis-
taken."
He said three' months had
passed before they gave their
statements to the police. and
four months after .Kevin
Adair recalled seeing a young
woman with Steve that day.
Donnelly said human reel
oltection is "notoriously"
unreliabk and suggested the
brief conversation Ryan and
Cafik testified they ,had with
Mistic may have been on the
long weekend. before May
31. when the couple first trust
Mistic and her best friend.
On the ether hand.
Donnelly reviewed a state-
ment made by Gordon
Ferguson in the defence case.
Ferguson. who now has brain
damage and is quadriplegia
after an accident, gave specif-
ic details about helping Steve
take his boat,out of the water
end.of the time spent •fishieg
•that day with a friend.
-Although-he. didn't know the
specific day. he provided
details that linked it to May
31.

David Wilson. a diver from
Blyth. saw Murray .alone in
his boat on -May 31 white
Wilson was diving near The
Cove.
Wilson said he heard the
noise of a boat 'approacitng
and saw it was Steve's boat.
Wilson was in the lake. away
front shore. preparing to
place markings on a ship
wreck. below.
Wilson new Murray from
the Park •House and could see
that it was hire behind the
wheel ul his boat. He didn't
see anyone else in the boat.
He described Murray's
path as he made it right turn
past the bccakwalls and back
through them toward the
piers.
That was around 7 p.m.

saw Murray again at the Park
House around 8 p.m.
Greenspan prudueed a
credit card statement to show •
Wilson had a Park House
Burger -Deluxe and two beers
:that night.
Wilson said he saw Murray
coming in the back door and
spoke to him briefly.
Under cross-examination.
Wilson said he was wearing a
hood and mask but had the
mask off his face when
Murray passed.
He said Murray's boat trip
took about three minutes.
