Questions on
farm transfers
- CONTINUED from page 3
'The money stays in the
family, it offers flexibility
and it's an effective tax
saver."
Questions & Answers
Many financial questions
were fielded by audience
members.
Q. If you incorporate your
farm, should you keep farm-
land out of the corporation`'
A. Generally you would
keep it out. But you don't pay
any land transfer tax if it's
put into a corporation. If
you're early in farming.
you'd probably leave it out.
Q. Does interest have to be
charged to children if land is
sold for less than fair market
value?
A. No.
Q. Can you appoint your
spouse beneficiary of your
NISA?
A. Yes, it's generally done
through your will.
Q. Would you appoint a
lawyer or Trust company for
the executor of an estate?
A. Cost is the main factor.
They would charge full rate.
But it would be professional
management. A lawyer
would likely consult with
some financial advisor. If you
-anticipated a major squabble,
you could appoint a third
party (lawyer or trust compa-
ny), who would be impartial.
Q. Does the executor have
to be the power of attorney?
A. You can have three dif-
ferent people if you want for:
1) Executor of estate
2) Power of attorney
3) Attorney for personal
Care
Powers of attorney are usu-
ally spouses.
