She testified all the equip-
ment was working properly
and met the required stan-
dards.
In the defence case. Kevin
Oliver testified. saying he told
the police he had two hccrs.
He also testified that. since 2
p.m. he had 'five beers. His
lawyer said the reason Oliver
told police he only had two
beers was because of the
phrasing of questions to which
Oliver was askedto respond.
Auseklis Perkons testified
for the defence as an expert in
rates of alcohol consumption
and elimination. Pcrkons testi-
fled Oliver should have had 0-
29m1 of alcohol per 100m1
blood when he tested at la.m.
based on a range alcohol elim-
ination rates for "seasoned,
social" drinkers.
He said the screening
device picks up elements
other than alcohol which
might alter its reading.
In his ruling. Hunter did not
accept Oliver's evidence and
said. "I am satisfied the
'breathalyser and roadside
screening' machines were
working right."
Oliver was fined $750 or 13
days and lost his license for
one year.
