LACAC MINUTES
According to LACAC min-
utes:
"The committee reviewed a
letter from the town's
soliciter indicating that sec-
tion 69 of the Ontario
Heritage Act allows for pros-
ecution under the Provincial
Offences Act for anyone who
contravenes the act. The
committee decided that in
light of council's stand
regarding the protection of
the facade of the building at,
24-28 Main Street which
recently horned (co -owned.
by Anstetts in Clinton and
Exeter) it is time for the town
to take- a more proactive role
in protecting and maintaining
the character of the, properties
in the heritage conservation
district (downtown) as well
as the. individually designated
heritage, properties in
Scal'orth."
The Anstetts haven't decid-
cd what they arc going to do
with the shell of their build-
ing yet, barricaded on
Seaforth's Main Street since
the hig blaze on 'the Canada
Day weekend.
LAWYER'S ADVICE
In a fax .from Ross & Ross
Barrister's & Solicitors to
Seaforth deputy -clerk -
Garrick received July 16
_ prior to the LACAC, meeting,
provided for council's perusal
at last week's meeting, the
Godcrich lawyer. advised:
",1 d(i not believe that a
notice can he registered op
title when an, owner of a her-
itage property 'bakes changes
without first obtaining The
consent of council. The
mechanism which such
hchavior is to he dealt with is
to he found under section)
69 of thc Ontario f-feritage
Act by way of prosecution
under the Provincial Offences
Act."
•
The correspondence from
the lawyer further comments:
"h would seem to me that
the integrity of the Town of
Seaforth as in any town lucky
enough to have buildings of
historic interest should be
vigorously protected. A pros-
ecution as provided in the
Ontario Heritage Act should
send a strong. signal to those
in ,town w.ho do not under-
stand the importance of pro-
tecting heritage properties.
"Obviously the desirability
of -living in a.town or visiting
a town and spending money
in 'it is augmented by the
town's environment.` Every
time heritage properties are
strippedlof or changed from
their original state the whole .
town suffers.
"Conversely, the town ben-
efits.if the municipality takes
a leading role by upholding
the nature and character'of its
heritage properties, by prose-
cution if that becomes neces-
sary "
ACTION THE AIM
Deputy -clerk Garrick
reported to council last
Tuesday night she expected
"a satisfactory compromise"
could be achieved in
LACAC's scheduled sit-
down with the Ryans Aug:
20:
Her recommendation how-
ever stressed it is still
LACAC's intent" to have
council take action against
owners and tenants of desig-
nated properties, in the
future, when the Ontario -
Heritage Act, or any other
law or -municipal bylaw is
contravened."
