OF AN INTERIM CONTROL BY-LAW
BY THE CORPORATION OF THE
TOWNSHIP OF HIBBERT
TAKE NOTICE that the Council of the Township of Hibbert passed
By-law No. 29-1995 on the 4th day of December, 1995 under
Section 38 of the Planning Act, R.S.O., 1990.
AND TAKE NOTICE that any person or agency may appeal to the
Ontario Municipal Board in respect of the By-law by filing with the
Clerk of the Township of Hibbert not later than the 2nd day of
February, 1996 a notice of appeal setting out the objection to the By-
law and the reasons in support of the objection.
An explanation of the purpose and effect of the By-law, describing
the lands to which the By-law applies is attached. The complete By-
law is available for inspection in my office during regular office
hours.

EXPLANATORY NOTE FOR
BY-LAW NO, 29-1995
By-law No. 29-1995 is an interim Control By-law which was passed
by Township Council pursuant to the provisions of Section 38(2) of
the Planning Act, R.S.O. 1990. The By-law amends By-law No. 17-
1995 by extending the period of time during which By-law No. 17-
1995 is in effect to June 4, 1997.
By-law No. 17-1995 is an Interim Control By-law which was passed
by Township Council pursuant to the provisions of Section 38 of the
Planning Act, R.S.O. 1990. The By -taw establishes all of the land in
the Township which is within the "Agricultural Zone One (Al)" and
the "Agricultural Zone Town (A2)" of the Township's Zoning By-law
No. 23-1986 as an interim control arca in which:
(1)
no new and/or expanded livestock and poultry barns and no new
and/or expanded livestock and/or poultry manure storage
facilities shall be permitted unless barns and/or facilities satisfy
the minimum distance separation required by Minimum
Distance Separation 11 (MDS 11) (March 1995 version) as
prepared by the Ontario Ministry of Agriculture, Food and
Rural Affairs arid the Ontario Ministry of Environment and
Energy; and
(ii) no new residence, institutional use, commercial use, or
recreational use shall be permitted unless such building/use
satisfies the minimum distance separation required by
Minimum Distance Separation 1 (MDS 1) (March 1995 version)
as prepared by the Ontario Ministry of Agriculture, Food and
Rural Affairs and thc Ontario Ministry of Environment and
Energy.
A complete copy of By-law No. 17-1995 is available for inspection
in my office during regular office hours.
CORPORATION OF THE
TOWNSHIP OF HIBBERT
BY-LAW NO. 29-1995
WHEREAS pursuant to the provisions of Section 38 of the Planning
Act, R.S.O. 1990, the Council of the Corporation of the Township of
Hibbert enacted By-law No. 17-1995, referred 10 as an Interim
Control By-law for prohibiting certain uses of land, buildings, and
structures within the municipality or within specific areas, defined in
such by-law until December 5, 1995'.
AND WHEREAS, pursuant to the provisions of Section 38(2) of the
Planning Act, R.S.O. 1990, the council of a municipality may amend
an interim control by-law to extend the period of time during which
it will he in effect, provided the total period of time does not exceed
two years from the date of the passing of the interim control by-law;
NOW THEREFORE the Council of the Corporation of thc
Township of Hibbert enacts as follows:
1. By-law No. 17-1995 shall be in effect until June 4, 1997.
2. This By-law shall come into effect on the final passing thereof
by the Council of the Corporation of the Township of Hihhert
pursuant to the provisions of Section 38 of the Planning Act,
R.S.O. 1990.
