One often overlooked, but very necessary task is that of obtaining a marriage licence. 1b help make the wedding plans go just a little smoother, here's a list of the requirements for tying the knot. • Anyone who is 18 years of age or older and meets with the requirements of the Prohibited Degrees of Affinity and Consanguinity (the blood relationships between relatives who are disallowed to marry), may obtain a licence or be married under the authority of the publication of banns. • A minor, 16 to 18 years of age, may be married if he or she obtains the necessary written consent on the form Consent of Parent or Guardian to Marriage. (A judge may use his discretion and waive this form if the case is presented to him). Those who are under the influence of intoxicating liquor or drugs, and those who are mentally ill, will not be granted licence to marry or have a marriage solemnized. ACQUIRING A LICENCE V Marriage licences may be issued by the clerk of any city, town, village, or municipality at a cost of $50. • If both the bride -and - groom -to -be are Native Canadians living on a Reserve or Crown Land in Ontario, no fee is charged for a licence, but a special affidavit must be signed by one of the partners. • Necessary documents for obtaining a licence are: birth certificate or passport, and if previously married, the original or notarized, copy of the divorce certificate or annulment certificate. • If both partners do not go to get the licence, one partner must produce the birth certificate or the passport of the absent partner. A special Affidavit of Age form can also be obtained and taken tote signed by the absent partner if a birth certificate or passport is not available. • An applicant whose spouse is assumed to be dead must meet the terms of, and present a Presumption of Death order. )YBLICATIOII OF BANNS • In Ontario, parties planning to marry have the choice between obtaining a marriage licence or having a publication of banns proclaimed in their place of religious worship. • The intention to marry must be announced openly in an audible voice by the minister during divine service. • Conditions placed upon publication of the banns are that both partners must be in the habit of attending worship at the same church, or, if they both regularly attend different churches, the announcement must be made at both churches. • A person who is divorced or has had a previous marriage annulled is not eligible for publication of the banns and must purchase a licence. TINE LIMITATION! • A marriage cannot be solemnized until the third day after the purchase of a licence or until the fifth day after the publication of the banns. • The marriage must take place within three months less one day after the purchase of a licence or the publication of the banns.
