Council was faced with a request from
Van Diepenbeek to return a $170,000 letter
of credit from Van Diepenbeek's bank that is
serving as security on lands he had planned
on developing. The motion died as there was
no mover or seconder. The security is to re-
main in place should it prove necessary to run
hydro and other services to the properties.
Having the letter of credit out in his name
costs Van Diepenbeek $3,000 to $4,000 a
year in interest, he said.
Council had previously alluded to the fact
that it might be possible to set out an agree-
ment in which the letter would be returned
to the bank, thus making future interest pay-
ments unnecessary. The Reeve would then
have to place another security deposit on
the lands before they could be sold or devel-
oped.
Council heard from Brad Vanstone, who
voiced concerns about Van Deipenbeek's re-
quest, stating that, had he known this was an
option, it would have changed his decisions
when finalizing his own land development
plans.
Vanstone, who developed land parcels in
Benmiller, chose to develop only five lots, in-
stead of splitting them and creating ten lots,
as he couldn't afford the secuirty deposit.
After some debate about other options,
council decided that there was too much risk
in granting Van Diepenbeek's request, and
that it could open the door to too many re-
quests from other developers.
Council, despite starting the debate saying
that they were comfortable with returning the
letter of credit, unanimously decided against
returning the funds.
"It's just too inhumane to expect the rest of
the township to cover for the potential costs
that could arise fit' land developers left with-
out paying for necessary infrastructure],"
Coun. Barry Millian said.
