Box 152 Bayfield, ON NOM 1GO p: 519-5655336 f: 519-565-5345 c: 519-242-7366 e-mail: ianmatthew@tcc.on.ca NOTICE OF APPLICATION TO MUNICIPAL COUNCIL FOR EXEMPTION FROM THE REQUIREMENTS OF THE NOISE BY-LAW Rehabilitation of the Bayfield River Bridge Site 12-188, Highway 21 (GWP 3042-08-00; WP 337-97-15) From June 2009 to November 2009 Notice is hereby given that the Ministry of Transportation, Ontario (MTO) is making an application to Municipal Council for exemption from the requirements of the Municipality of Bluewater Noise By -Law Number 21-2005, as amended, to allow overnight work for the rehabilitation of the Bayfield River Bridge on Highway 21. This exemption is requested to permit continuous operation where necessary during the rehabilitation project. Construction activities will result in a temporary increase in noise due to implementing lane closures and the operation of construction equipment (i.e., on-site generator, small chipping hammers, saw cutting and abrasive blasting). The contractor will be required to adhere to standard noise restrictions (i.e., proper maintenance of equipment, no unnecessary idling, etc.) and there will be no work undertaken on weekends or holidays. However, in order to mitigate impacts to the traveling public, some work will be completed during off-peak hours (i.e., nights after 8:00 p.m.). The ministry is requesting exemption from June 2009 to November 2009 in order to complete the construction work. The Municipality of Bluewater Council will consider this application for exemption from the requirements of the Noise By -Law at a Public Hearing of Municipal Council to be held on June 1, 2009 at 7:00 p.m. in the Council Chambers at the Stanley Complex, 38594B Mill Road, R.R. #1, Varna, Ontario. Individuals who feel they may be adversely affected by such an exemption or wish to make their views on this subject known to Municipal Council, should contact the Chief Administrative Officer at 519-236-4351, ext. 226, by no later than 12:00 p.rn. on Thursday, May 28, 2009.
