case was reported as having been ar-
gued before the judges of the
court at Toronto on Tuesday: Judg-
ment (R) on appeal by defendant from
Judgment, of MacMahou, Y., at the
trial at Goderich, in favor of the plain-
tiff for $300 and costs in an action for
damages for breach of an agreement
whereby, .in consideration of $1,300
paid be plaintiff, the defendant agreed
to furnish and instal for the plaintiff,
in his millein the village of Zurich, an
electric light plant, consisting of dy-
namos, poles, wires, volts, meters, etc.
The plaintiff . complained that the
plant reit in by the defendant was se -
coed -hand and inferior. in qnality' to
that contracted for, and did not an -
serer the purpose for which it was in-
tended, and that portion of the amount
was re -adjudicate by reason of a set-
tlement of an action in a division
court, of which that portion formed
a part of the claim. Held, Britton,
dissenting, that the findings of fact
below were correct: that theaction
was not for breach of warranty, but
damages for not getting ee,w dynamos
contracted for, but old ones repainted
and of less value; Swain v. Hughes, L.

court had gone to judgment it would'
