GENTLEMEN:—In accordance with instruc-
tions received from your honorable body I
llavemade auexamnination of the ditch' or
drain commonly known as the "Mud Creak
Drain" commencing at the• line between
lots 11 and 12 it the lOth concession in the
Township of Stephen and extending norfh-'
arty across lots 11 to 15 both inclusive .in the
10th Con, of the Township of Stephen and
from lot it South to lot 5 tax con to both. in-
clusive and from lot 6 con, to South through
Iots 4 con. 8 both 100103ive con. 111ot 2o 8 B
Stephen and across lee 20 in the N Belly,
con, of the Township of McGillivray and
across lots 3 4 and 6 in con.11.
In making au examination I find that the
drain above described is for thorn est part in
a very bad condition having flied in consid-
erably since originally constructed and be-
ing altogether tee small 11.1 capacity to con-
vey the water from the lands above described
and that flowing upon them from'the higher
lands above, much to the damage of adjoin-
ing lands and roads.
I also find that in order to obtain a proper
eutlot in the Township of McGillivray it
will also be necessary to deepen, widen and
strengthen the creek from the present outlet
across lots 3,4, and Sin the 15th concession
of the said Township and that the adjoining,
lands would he more or less improved.
'have made the necessary .survey of the
above work and have staked it out and have
taken levels, commencing at the line be-
tween lots 11 and 12 in the 10th concession
as shown on plan, hereto attached, placing
stakes along edge of drain twe chainsor
eight rod's apart and taking levels at same
and in bottom of ditch, where no change fn
course is necessary throughout. The stakes
are numbered o, 2, 4, G, etc., and the levels
are taken on the ground beside the same.
In the assessment I have endeavoured to
distinguish between the higher and outlying
lands and the adjacent and lower lands
orbital' will evidently receive the greater ben-
efit

Where the drain passes through timbered
ands the trees to be felled and alllogs and
rushwood to be removed so lar from the
dgo of the ditch that none may bo covered
y the earth excavated. The earth to be
brown out 3 feet clear of the edges of the
itch and so equally as possible on both sides
f same and spread ••o a depth not exceeding
1 foot unless otherwise ordered by the En-
gineer or Inspector In charge of the work.
Whenever the drain leaves the old channel
of Creek at any crooked place for the pur-
pose of streightening the same and imerov-
rng the flow of water, the earth excavated to

And whereas the said council are of the
opinion that the said deepening, widening
removing obstructions artd"better ontletearei

Beit therefore enacted by the said munici-
pal council of the said Township of Stephen,
pursuant to the provisions of the municipal
Act.
1st That the said report, plan and estimates
be adopted and the said deepening, widening
removing obstructions and better ontletland
the works connected therewith be made' and
oonstrnetedin accordance therewith,
2nd That the Reeve of the said Township
may borrow on the eredit of the Corporation
of the said Townsbip of Stephen the sum *of
81974,53 less the amount payable by McGilliv-
ray being tltefuuds necessary for the work
artdmay issue debentures of the corporation
tothat'amount in sums of not lessthan 8100
and payable within 10 years,,from the date
thereof with interest at the rare of 5 per
cent. per annum that is to say in 5 equal an-
nualconsecutivo instalments, the first of
which shall be due and payable one year
from the date on which this by-law shall
have been finally passed,and all such debent-
ures shall be payable at the Molsons Bank at
Exeter, And the interest thereon shall be
includedwith the principal payable with
each debenture,
3 That for the purpose of paying:the sum

pality, and to cover interest thereon for ten
years at the rate of 5 per cent per annum,
the following special rates over and above
all other rates shall be assessed and levied

the said special rates and interest assessed
as aforesaid against each lot or part
of lot respectivoly shall . be divided Into
10 equal parts. and one such part shall be
assessed and levied as aforesaid in each year

Om Press says: -"As time wears on the old
et- pioneers. of our country pass arvav to
their eternal rest,' On Jan. 14th Sas.-
son Popplestone, Esq , of Exeter, Ont..
died having reached the advanced age
of 75 rears,4'9 months. He was a native
of Altd'rnon Parish, Cornwall, England,
and came to Canada on the ship Daid-
Iess, of Padstow, Captain Nicholas, in
1848, staying for one year with Mr.
Wilmot, of Clarke Township, and after-
wards came up to - the Huron track
and worked as head teamster for Mr.
James Pickard, of Exeter, for twenty-
six months. He' then settled on the
third lot, third concession, of Usborne,
and soon afterwards married Rebecca,
eldest daughter of James Brown, Esq.,
then of Bidciulpb. He hewed out of the
forest a most comfortable home,. and.
lived there until 14 years ago he sold
his farm and retired in Exeter. He
always enjoyed the best of good health
until .1a, grippe took a fast hold on him,
and sett]ed on 'the bronchial tubes an'd
heart with such seyerity that no medi-
cal skill could do anything to bring
about his recovery. He was popular
with every person, and his familiar
figure will be missed by many. He
was a meniber of James Street Metho-
dist Church for many years. and was
ever attentive to church, very seldom•
missing his class or church. He was
all his life a liberal Reformer (and al-
ways respected the fair political ideas
set forth by the London FREE PR.Bss,
of which he was cue of the oldest sub-
scribers.) His family consisted of Mary
who died in 1880,and Mrs C W. Welsh
of Usborne, and Samuel A, of Exeter.
He leaves behind him a sorrowing''
widow, daughter and son, who have'
the sincerest sympathy of the com-
munity.

Rev. Jas. Pritchard, of Forest, con-

Hay Council,
Hay council met pursuant to statute
in the town hall Zurich, on Jan. 15th,
at 11 a. m. The following members
were present and made declaration of
office and qualification. Geo McEwen,'
Reeve; Moses Geiger, Second Deputy
Reeve; W Buttler and Robt Meilfordie,
counsellors. The following were de-
clared to be the salaries for 1894, Clerk,
$110 ; Treasurer, $85 ; Collector, $60 ;
Assessor, $60; Auditors, $6;, Caretaker,
$20; Board of Health, $2 each sitting.
All the old officers wore re appointed
with' the exception that Mr. D. Ur-
quhart, of Hensall,was appointed audi-
tor, The contract of printing was let
to John White & Son, of Exeter Times,
at $44.75, The Clerk was instructed to
ask for tenders to be received up to
Feb, 15th for 10000 ft of beech and
15000 ft of cedar for use of the town
ship for 1894 The Clerk was instruct-
ed to notify* the engineer to inspect the
Hartman Witdfong ditch, and let the
job of completing the sarne according
to the award. A number of accounts
were paid and the council adjourned to
meet again on March 3rd at 10 a, m, at
which meeting the pathmasters will be
