Court news Man gets 90 days in jail on assault charge A Blue vale man was sentenced to 90 days in jail after pleading guilty in provincial court. Wingham. Sept. 15 to assault causing bodily harm and to breaching a probation order. According to attorney for the Crown. L. McFalls police in Wingham had been dispatched to the hospital at 2 a.m. April 7 regarding an assault. The victim said he had been walking with a friend, when the accused. McFalls said McDougall struck the victim in the face and walked away, saying he wondered what the brother would do when he saw what McDougall had done. The victim sustained a fractured cheekbone and swelling. Following his arrest McDougall was released on the condition that he stay away from the victim and that he be under a curfew. On May 26 police were told that McDougall had been out past the curfew and had spoken to the victim “calling him names and asking where his brother was.” Defense counsel S. Menzies, told Judge R.G.E. Hunter that the situation regarding the breach charge had actually occurred on his client’s property and called it at the “low end” regarding severity. McFalls disagreed, however. “My position is that it’s on the high end when you are on probation and contact the complainant." Menzies described the relationship between his client and the victim's brother as “very unpleasant". Hunter sentenced the 22-year-old accused to 75 days for the assault and 15 days consecutive for the breach of probation charge for a total of 90 days, to be served intermittently. He was also placed on 12 months probation and is prohibited from owning firearms for five years. PRE-SENTENCE REPORT An RR3, Brussels man accused of careless use of a firearm and of possessing a firearm without a licence pled guilty to both charges. A pre-sentence will be presented for Larry Jerome Rice on Dec. 8. ASSAULT Hunter requested a pre-sentence report for an RR5, Lucknow man who pled guilty to assault causing bodily harm. Kyle Dorscht was charged Jan. 16 following an incident in Morris- Turn berry. According to McFalls, the victim was leaving a house party when he was grabbed by Dorscht, who punched the victim in the facet and knocked him unconscious. Friends took the victim to the hospital where he was treated for a shattered cheekbone and eventually underwent surgery. He has sustained some nerve damage as a result of the injury, said McFalls. Defense counsel D. Donnelly presented a joint submission for 90 days intermittent and a period of probation for the 19-year-old accused. The pre-sentence report will be presented at the Nov. 17 court. OVER 80 Maryanne McCreight of Wingham Kudos for Alliance hospitals On Wednesday.
