had walked away from the initial
altercation without injury, w'hile
Visser was bleeding from his head.
“In view of the fact that you so
quickly defended yourself, why not
go home? Why tempt fate'.’”
“I thought it was a good idea at
the time.” said Barlow.
Two defence witnesses, friends of
Barlow’s who were with him that
night, backed up his story.
Cornish called the incident, “an
acute situation that developed into
something of a difficult evening.”
He noted that his client had felt the
issue was not over after the initial
interaction.
Cornish also said that the victim
was “the most beligerant witness
sermon centred on water. Emily,
Sarah, and Sean Mitchell played the
piano and Sean gave a violin solo at
church on Sunday too.

What occurred was “given and
taken in kind. It was verbal fencing.
Would a better person have walked
away? Maybe,” said Cornish,
adding that he felt male pride had
prevented that.
Hunter felt, however, that
Barlow's third trip to the house
clearly proved his guilt. “If that’s
not causing a disturbance what
is?"
Regarding the resisting arrest,
Cornish argued that Barlow had not
been given a clear indication of
what he was being arrested for. And
that while he did flee it was not
unexpected in light of his client’s
state of mind and his claim that the
officer had used pepper spray .
NEWS
FROM CRANBROOK
“There have probably been worse
cases of resisting arrest.” said the
judge. “But I accept the evidence of
the officer.”
Regarding the resisting arrest
charge. Hunter felt there could have
been little doubt in Barlow’s mind
what he was being arrested for.
Barlow has no record, is
employed full-time and is a reservist
with the military. The incident, said
Cornish, “was entirely out of
character. He regrets what happened
that evening.”
Hunter granted a conditional
discharge and placed Barlow on 12
months probation.
He must also complete 150 hours
of community service work in nine
months.
