Court news
Man gets jail for area break and enters
It's weekends in jail for awhile for
a London man.
George Shaw entered a guilty plea
in Wingham's December provincial
court, to several counts of break and
enter and one count of mischief, but
facts and sentencing were put off
until Jan. 15.
Crown attorney Bob Morris said
that between Dec. 9 and 11 several
businesses, in Wingham, Auburn and
Belgrave, were broken into and a
number of items stolen.
Later on Dec. 11, a search was
conducted at a Wingham residence
where Shaw was present. Some of
the stolen property was recovered.
The mischief charge dates to July
22, 2002, when Shaw threw two ball
bearings through the window of a
business.
One other person was involved,
Morris said.
Duty Counsel John Schenk told
Judge R.G.E. Hunter that Shaw had
terminated his friendship with the
co-accused.
He was sentenced to 90 days
concurrent on each charge, plus
received two years probation.
Drunk driving
Matthew Warner of Brussels pled
guilty to driving with over 80 mg of
alcohol in 100 ml of blood.
Morris said on Nov. 28 at about
9:50 p.m. police in Wingham
stopped a car that had been travelling
at a high rate of speed. They noticed
open liquor in the vehicle and
detected an odour of alcohol coming
from the driver as he exited the
vehicle.
Breathalizer readings were 150
and 140 mg of alcohol in 100 ml of
blood.
Warner has a prior conviction for
over 80 from March 29, 2000 in
Manitoba.
Hunter sentenced him to 14 days
in jail. His licence is suspended for
two years.
Fined $1,000
A Wroxeter man entered guilty
pleas to a charge of assault and two
of failing to comply with a court
order.
Morris said that during an
argument Jan deBoer had slapped
the victim and put his "hands in the
area of her throat" while pushing her.
The Crown also explained that
deBoer, who had lived with the
victim, had been found guilty in
November 2002 of assaulting her.
He was ordered at that time to have
no further contact.
The two, by mutual consent, began
to co-habitate again, said Morris,
thus putting him in violation of that
order.
As well, he had been drinking,
which was also in violation.
Taking into account the nine day
pre-trial jail time, Hunter fined
deBoer $500 on the assault and $250
on each of the fail to comply orders.
He was given six months to pay.
deBoer is also prohibited from
owning weapons for a period of five
years.
Impaired
Donice Donaldson of Bluevale
was charged with impaired driving
May 11. She pled guilty.
Morris said Donaldson was
noticed by police because of her
erratic driving. After stopping her,
officers detected an odour of alcohol
and saw physical signs of
impairment.
Donaldson admitted to police that
she had had four or five beers then
was placed under arrest for impaired.
Breathalizer readings were 170 and
190 mg of alcohol in 100 ml of
blood.
Schenk noted that Donaldson had
driven for 30 years with no
convictions and was "obviously co-
operative."
She was fined $750 and is off the
road for 12 months. She has six
months to pay the fine.
Auto theft
Dennis McLean of Wingham and
Eric Millen of Hamilton pled guilty
to occupying a stolen vehicle and
auto theft, respectively.
According to Morris police were
called after a witness saw the two
driving away and gave chase. She
provided a detailed description.
Another vehicle, which had been
reported stolen, was found nearby
and the police believed the two were
linked.
According to Schenk this was a
"prank gone bad." The two, who
have no record, were friends with the
owner of the first vehicle. Seeing the
keys inside they thought it would be
fun to move it up the street.
They were given a conditional
discharge and placed on 12 months
probation.
Marijuana possession
- Curtis Thornton of RR2, Gorrie
received a conditional discharge
after pleading guilty to possession of
marijuana.
Federal crown Mike Donnelly said
that on Oct. 15 Thornton, a student at
F.E. Madill Secondary School, had
been brought to the office because he
was acting "strangely. His speech
was slurred and his eyes were
glassy".
Thornton "ultimately produced a
small bag" of marijuana.
The accused, who has no record,
was placed on probation for 12
months.
