Court report 2 plead guilty to drunk driving charge Two men pled guilty to drunk driv ing charges when they appeared in Wingham’s provincial court, Aug. I7. James T. Schmidt of Waterloo was charged July 6 after police were called to the scene of an accident in East Wawanosh Twp. According to Attorney for the Crown Tim Macdonald, the car had left the road and ended on a lawn. Schmidt identified himself as the driver and said there were three pas sengers. No one was injured. Breathalizer readings were 120 mg of alcohol in 100 ml of blood. The 18-year-old was fined $750 and prohibited from driving for one year. Justice John Menzies gave him 30 days to pay the fine. Chad Ryan Sellers of RR3, Wingham was stopped by police in Wingham on July 5. Officers detect ed an odour of alcohol and Sellers admitted to having consumed a cou ple of beers, Macdonald said. His breathalizer readings were 160 and 150. He also received a $750 fine in addition to the mandatory driving suspension. He was given six month to pay. Indecent exposure Two men pled guilty to charges of committing an indecent act. Macdonald said that on July 5 around noon a 12-year-old and 14- year-old while outside. their home saw their neighbour, Robert Alvin Higgins of Wingham, expose him self and masturbate. The children set up a video camera and later caught Higgins masturbat ing on his front porch. He has a record from 1990 for committing an indecent act. Taking into consideration the fact that Higgins is 80 years old Macdonald suggested a fine and pro bation with counselling. Justice John Menzies suspended passing of sentence and impose a one year pro bation period. Higgins must receive counselling and is not to have any communication with the two wit nesses. “Commit this offense again notwithstanding your age you’ll go to jaiI,", admonished Menzies. George Wilkinson of Lucan was charged June 30 after police were called to an apartment building in Wingham. Macdonald said the com plainant told police that a man had appeared at her patio door, naked, then returned later wearing only a bag over his face. After a third appearance at her door she called police who found OPP investigate theft of motorcycle YOUTH HURT ON BICYCLE - CLINTON On Aug. 15 at approximately 1:30 p.m. a youth on a bicycle was struck at the intersection of Huron Street (Hwy. 8) and Orange Street in Clinton. Len Beisinger. 16, of Hullett Twp. near Londesboro was attempting to cross Huron Street when he was struck by a 2000 black Toyota driven by Philip Bumess, 34, of London. The youth received minor injuries and was transported to the Seaforth Public Hospital where he was treated for his injuries. No charges will be laid in the col lision. When Duty Counsel John Myers said that Wilkinson, who had pled guilty to the charge, had been sleep ing at his aunt’s and had been roused by an outside noise and gone to investigate when police discovered him, Menzies questioned the guilty plea. “Either he agrees with the facts or disputes them and there’s a trial,” the judge said. “Do you unqualifyingly admit those facts are correct,” Menzies asked Wilkinson, who responded yes. He was fined $300 and placed on probation for 12 months during which time he is to receive coun selling and have no communication with the complainant. Assault MOTORCYCLE, TOOLS STOLEN FROM SHED - HUL LETT TWP, On Aug. 15 shortly after 2 a.m. the Clinton Fire Department called offi cers to Wildlife Line in Hullett Twp. The officer found that a person had set a 1981 Kawasaki green coloured dirt bike on fire, completely destroy ing it. Later that day the motorcycle was reported stolen from a driving shed located on Hydro Line in Hullett Twp. The bike was stolen from the shed sometime between midnight and 2 a.m. The owner also found that $2,000 Michael Cooper, 18 of Brussels pled guilty to a lesser charge of com mon assault. Macdonald said that on April 5, the victim and two friends were walking across a parking lot when Cooper pulled up and asked the complainant. “What the------are you looking at?” The baiting continued, Macdonald said, until Cooper punched the vic tim twice in the nose and ears. Cooper was on probation at the time for possession of stolen proper ty. Macdonald asked that this proba tionary period be extended. He was fined $300 as well. A con dition of the probation is for coun selling and non-association with the complainant. Mischief A London man pled guilty to mis chief under $5,000. Macdonald said Andrew Jacob Mair was charged worth of tools had also been stolen. Some of the tools were hand tools but others were air impact wrenches, a drill and a grinder. FOUR ARRESTED FOR ATV THEFT - BLUEVALE On Aug. 15 at approximately 8:15 a.m. the owner of an ATV reported it stolen from his residence on Clyde Street in Bluevale. The owner told police that some one had entered the driving shed through the night and removed a 1999 Suzuki Quadrunner valued at March 4 after police were called to break up a fight at the Wingham Inn. Mair had broken two chairs and some glasses. After a struggle with police he was eventually arrested. Defense said his client, who is 22, had had more alcohol “than is good for him”, and noted that alcohol has been a factor in past problems with the law. He was fined $500 and placed on one year probation during which time he is to receive counselling for substance abuse. The order has been transferred to London. Mair must also make restitution in the amount of $200. He has three months to pay. Fail to appear Mary Brooks of Brussels appeared at the July sitting of court and pled guilty to failing to appear. She was fined $300 and given 60 days to pay. $9,000. An officer working the night before remembered meeting a truck and ATV on County Rd. 12 north of Wroxeter at approximately 4 a.m. The officers had obtained a name of one of the four men seen in the area. Later that day one person was arrest ed that led to the arrest of three more men and the recovery of the stolen ATV. Charged with theft over $5,000 is Matthew Vock, 24, of Mitchell, Timothy MacTavish, 24, Kenneth MacTavish, 23 and Kevin Campbell, 21 of Bluevale.
