Judge agrees man not responsible for actions The man involved in the Sept. 30 incident at Brussels Livestock had his day in court July 20. Eric Scheurwater, RR5, Paisley appeared in Wingham before Judge Garry Hunter and pled not guilty to the charge of operating a motor vehi­ cle in a manner that was dangerous to the public on the grounds that he was not criminally responsible for his actions. Scheurwater had rammed 11 vehi­ cles with his pick-up after being ejected from the sales bam. Said Attorney for the Crown Mark Garson. “His driving was described as being of a such a manner as to endanger the lives of people there.” A psychiatric evaluation from London was presented which con­ cluded that at the time Scheurwater was suffering from a mental disor- Blyth council briefs der. Hunter granted him a conditional discharge. He must reside in Ontario, abstain from alcohol or the use of other intoxicants, remain under psychiatric supervision with a follow-up every two weeks and be involved with family and children’s services until they determine it is no longer required. Sexual assault An RR3, Brussels man will be sen­ tenced Sept. 21 after being found guilty of sexual assault. Henry Kienapple, who pled not guilty, was tried in June court but Hunter took a month to review the evidence before reaching his verdict. He said he found the minor male vic­ tim to be a “believable witness” and accepted the evidence that the “accused had touched in him an inappropriate fashion.” Over 80 A London man pled guilty to drunk driving. Jeffrey Porter was charged after police stopped him in East Wawanosh Twp. on June 17 in a routine sobriety check. Breathalizer readings were 150 and 135. He was fined $750 and had his license suspended for a period of one year. Possession of stolen property Kenneth Heimpel of RR2, Clifford pled guilty to possession of stolen property. Garson said that Heimpel was the driver of a truck that was seen pulling into a store parking lot in Wingham. A female passenger got out and after entering a tented area came out with a lawn chair. The chair was found later in Heimpel’s possession. It was returned to the store. Heimpel was granted a conditional discharge and placed on 12 months probation. False pretenses An RR3, Clifford woman has six months to make restitution on a series of bad cheques. Patricia Cline wrote a cheque, Jan. 8 for $315 to Radio Shack in Wingham for services, one Feb. 6 to the Valu-Mart in Wingham for $142.45 and one Feb. 14 to the Wingham Value Centre for $101.40. All were returned NSF. Cline has begun to make restitu­ tion, Duty Counsel Tom White said. She was also placed on probation for 12 months. Assault Hunter suspended passing of sen­ tence for Terry John Harcourt of Wingham, who was charged with assault. The victim, who accompanied Harcourt to court, testified that she had been struck in the face but had sustained no injuries as a result of the altercation which occurred Jan. 16 in Wingham. Harcourt was placed on probation for one year and is prohibited from owning weapons for a period of five years. Narcotic possession Tim Mulvey of RR1, Wroxeter pled guilty to possession of /narcot­ ic. Garson said police saw a group of young people in an alley in Wingham April 28. Mulvey was found to have a small quantity of marijuana in his possession. He was fined $100. Threshers diseuss agreement with village Thresher association members George Underwood and Edgar Daer attended the July 17 meeting of Blyth council to discuss the agree­ ment between the village and Huron Pioneer Threshers and Hobby Association. Part of the process included phras­ es in the agreement to protect the arrangement once amalgamation has occurred. Comments on the agreement will be sought from the village solicitor.*** Reeve Mason Bailey was author­ ized to sign a letter to municipal employees indicating that their employment w'ith the village would cease as of Dec. 31, 2000. *** Clerk-Treasurer John Stewart advised council there is continued progress with the sale of Blyth PUC to Hydro One.*** The village had received a field order from the Ministry of Environment indicating that a certi­ fied operator must be in place by Aug. 1, to operate the water system. Stewart had contacted Ken Saxton of Wingham PUC about providing the service. The field order has nothing to do with water quality. *** Authorization was given for the payment of bills and accounts in the amount of $128,828.83. *** Council will reimburse Ken Johnston $200 for sidewalk repairs at his home. *** With the block wall at the arch Stolen car involved in crash On July 22 at 10 a.m.. the owner of a 1986 Fifth Ave., white in colour, reported it stolen from a residence in Ashfield Twp. on Cone. 8. The owner told police that some­ time through the night the unlocked vehicle was stolen from the drive­ way when the keys were left inside. Two hours later the vehicle was dis- falling in, council instructed village employee Murray Siertsema to hire Carl Nesbitt to make the necessary repairs. *** There were no objections to appli- covered on Belfast Line in West Wawanosh Twp. up against a tree.
