Man gets house arrest for aggravated assault A Wingham man is going to be spending a lot of time at home. Kent Bieman was sentenced in Wingham’s provincial court, April 20 to 90 days of house arrest having pled guilty to aggravated assault at last month’s sitting. Defense Counsel Tom White said the pre-sentence report “explained a lot” about his client’s life. According to White, on the night of the assault, Sept. 26, Bieman was with friends at his apartment, when the victim showed up uninvited, then created a disturbance. It was after he “hit” a female friend of Bieman’s that the accused got angry and with a group of friends chased the victim to a parking lot. Saying that Bieman got hold of his senses, White described his role in the assault as “out of character”. “He realized what he did is serious and has serious consequences.” Bieman has begun taking anger management at his own suggestion feeling the outburst was enough to warrant it, said White Noting his client has no prior record and drawing Judge Garry Hunter’s attention to the fact that even the arresting officer has had good things to say about him. White said Bieman knows he “has to take control of who his friends are.” Straight incarceration of 30 days would result in a loss of pension, White said, that would not likely be given back. Hunter asked what effect a condi­ tional sentence would have. White said his client would be able to con­ tinue working and could keep his pension. “My concern is the length of time, because Kent can be led.” Hunter wondered, given that cir­ cumstance, if Bieman would be bet­ ter off living with his parents for the sentence. However, though the par­ ents were willing Bieman said he would prefer to continue living on his own if possible. Citing the nature of the offense, “being a cowardly act”, Attorney for the Crown Lyn Hall, asked for 90 days which could be served intermit­ tently. Prior to sentencing, Hunter told Bieman “but for the contents of the pre-sentence report there is little doubt in my mind you’d be doing straight time.” He imposed a 90 days conditional sentence. The only rea­ son Bieman can be outside his resi­ dence during that time is for work, medical or to see his probation offi­ cer. When the sentence is complete he will serve 12 months probation. Drunk driving Two men are off the road for a year after pleading guilty to driving drunk. Daniel Dickinson, 36, of RR3, Listowel was charged in Grey Twp. March 4. Hall said the officer who stopped Dickinson noted an odour of alcohol and found a bottle of alcohol in the car. Breathalizer readings were 130 mg of alcohol in 100 ml of blood. In addition to the mandatory license suspension, Dickinson was fined $750. Thomas J. Pearson, 21, was charged March 12 in Brussels. Defense Counsel John Schenk said his client had been staying at a friend’s home, but after a few hours sleep, thinking he was fine, decided to drive home. Breathalizer readings were 120 and 101. He was fined $750 and suspended from driving for one year. Marijuana possession Three young men pled guilty to marijuana possession. Barry James Shurter, 21, of Kitchener was charged in Turnberry March 4 after police found marijua­ na during a routine RIDE check. He had two bags containing a small quantity. He was fined $100. Wesley Stapleton of East Wawanosh was charged in Morris, Feb. 19. Police found a small green bag with marijuana after stopping the 18-year-old’s car. Defense Charmian Hills’ request for a conditional discharge in light of the fact her client, “has never been in trouble before, that this was a simple lapse by a young man,” was refused by Hunter. He too was fined $100. Richard Haskins, 19, of RR4, Brussels was charged after police stopped him for speeding in Grey Twp. on April 2 and found marijuana valued at $20 and some “parapherna­ lia”, said Federal Crown Mike Donnelly.
