Court report Man to be sentenced in April for assault A pre-sentence report is being pre­ pared for a Wingham man, who pled guilty to aggravated assault in Ontario’s Court of Justice, Wingham division, March 16. Attorney for the Crown Frank Cameron said Kent Bieman was one of a group of people seen chasing the victim from a residence Sept. 26. Catching up to the man, they knocked him down and punched and kicked him in the head. The victim, discovered later by police, unconscious and bleeding, was taken to the critical care unit of a London hospital. He suffered sev­ eral injuries including a broken nose and broken orbital bones in his face. There was bruising to the body, both eyes were swollen shut, both sides of the thoracic cavity were bruised and there was trauma to the back. Defense counsel Tom White said Bieman stated he was not responsi­ ble for any of the head or face injuries. Bieman will be sentenced April 20. Over 80 An RR3, Clinton man is spending weekends in jail on a drunk-driving charge. Dean Lyon pled guilty to over 80 as well as a charge of narcotics pos­ session. Cameron said Lyon was found in Morris Twp., asleep behind the wheel of his van. The engine was not running. Officers detected a strong odour of alcohol and Lyon showed visible signs of impairment Located inside the van was a jar containing about two grams of hash. Breathalizer readings were 150 and 160. He has a related record from 1996 and 1997. Judge Garry Hunter sentenced him to 90 days on the drinking and driv­ ing charge to be served intermittent­ ly. He is on probation while serving his sentence, and is prohibited from driving for three years. Lyon was fined $200 for the nar­ cotics charge. Careless driving Being in a hurry cost a Wingham man his license and $1,000. Cameron said Trevor Huffman had driven through a lot on Aug. 28 and struck a parked vehicle, which then hit another car. Huffman then left the scene. Defense Counsel Glen Carey noted that his client had been attempting to “catch up to a friend.” He received a $500 fine each for careless driving and leaving the scene. His license is suspended for one year. Utter threat Ronald Riley of Wroxeter was fined $500 and placed on probation for 12 months as a result of threaten­ ing a person with bodily harm. On Jan. 7 Riley walked into the victim’s home, upset that the man had hung up during a phone call. When the victim went to call police Riley threatened to break his arm or leg if he told anyone what had hap­ pened, Cameron said. In addition to the fine, Riley is also to have no contact with the victim. There is a five-year weapon prohibi­ tion as well. Assault Richard Baxter of London pled guilty to assault. He was arrested fol­ lowing an incident Sept. 15. The accused got into an argument with the victim, who said he pushed her into the comer of the couch, increasing the pressure, said Cameron. When she screamed he put his hand over her mouh. The vic­ tim’s child was awakened, and Baxter left the residence. White, speaking on the defen­ dant’s behalf, said that Baxter has had no contact with the complainant since the incident and has no inten­ tion of returning to the area, with the exception of visiting family. He was fined $ 1,000 and placed on 12-months probation. He is to have no contact with the victim and is pro­ hibited from owning weapons for five years. Fraud A Lucknow man was charged with fraud Sept. 4 after depositing a bogus cheque at an ATM into a Brussels CIBC account, then with­ drawing the amount of $500. Murray Gardner pled guilty to the charge. Attorney Lynn Johnston asked for a second chance for her client, saying he was prepared to make full restitution that day. She added that Gardner is taking coun­ selling. He was fined $400 and placed on probation for one year. Restitution totalled $510.59. Theft Sandra Morrison of Goderich was arrested for shoplifting from Oldfield’s Pro Hardware in Brussels, Aug. 9. Morrison eventually turned over the CDs and cassette tape to police. She has a record for theft under $5,000 from January 1998. She was fined $400 and placed on probation for 12 months. A Moorefield-area man also pled guilty to theft having been arrested in Wingham Aug. 13. Cameron said Ryan Dekker was apprehended out­ side the liquor store by a clerk. He had a 750 mg bottle of whiskey under his jacket. Hunter fined the 19-year-old $100 and placed him on probation for one year. Possession A Milverton man, arrested for pos­ session of Ecstasy, Jan. 29 pled guilty and was fined $100. According to Cameron, police stopped a car in Grey Twp. for speeding. The officers saw what they believed to be marijuana in the driv­ er Shaun Moore’s lap and when they asked him to get out of the vehicle, noticed a pill bottle in the door. Moore said it was Ecstasy, which he had purchased in Kitchener. Moore has no record. In addition to the fine he was placed on 12 months probation. Suspended sentence A Brussels man who stepped in to stop an altercation among some chil­ dren found himself pleading guilty to assault. Chris Whittemore was raking his lawn when he noticed some little girls crying and some boys throwing things. He approached the group and after exchanging words, raised his knee into the victim’s stomach. Attorney Dan Murphy explained his client’s actions saying that Whittemore basically saw what he believed to be bullying. “The other children left and this one stood up to him. He lost his cool.” Whittemore was placed on 12 months probation and told to have no contact with the victim. He is pro­ hibited from owning weapons for five years. Of maybe you couldn't walk. The pair was charged with posses­ sion ofi stolen property, not theft as stated. The story involved the pur­ chase of a stolen ATV. The men, who pled guilty received a conditional discharge.
