Oshawa man answers to fraud charges
An Oshawa man must make good
on some bad cheques or face another
day in court.
Robert Dickson appeared before
Judge R.G.E. Hunter in Wingham’s
provincial court, April 17 and pled
guilty to four counts of fraud.
Crown Attorney Bob Morris said a
cheque written out to a Brussels
business on Sept. 5, 2001, for the
purchase of a car engine, in the
amount of $325 was returned for
non-sufficient funds. The victim was
also out $25 for a bank surcharge.
On Sept. 28 of that year, Dickson
wrote a cheque for first and last
months' rent for an apartment in
Brussels. Morris said that cheque was
returned Oct. 15 because the account
on which it had been written was
closed. The amount was $500.
On Feb. 23, 2002, the accused
cashed a personal cheque in the
amount of $963 written on another
closed account. Then on April 1, he
deposited a cheque in the amount of
$2,876.53 made out to himself at a
bank in Listowel. This too had been
written on a closed account.
Dickson has no similar record,
Morris told the judge.
Defense Counsel Frank Cameron
said the matter had been put over
repeatedly in the hope that Dickson
could make restitution. This, said
Cameron, “he was not able to do as
quickly as he had hoped”, because of
several personal setbacks.
Dickson had, however paid back
the first two cheques and proposed to
make restitution of $250 a month
until the remaining balances are paid.
In addition to restitution, Hunter
suspended passing of sentence and
placed Dickson on 18 months
probation.
Fraud
Donald Clarke of Blyth, pled guilty
to fraud. He received a suspended
sentence and was placed on probation
for 12 months. He must make
restitution in the amount of $747.43.
The charge arose after a cheque
made out to the complainant in
payment for work, found its way by
mistake into Clarke’s post office box.
Morris said the accused attempted to
cash it at the bank and when they
refused he misrepresented himself to
the individual who had written the
cheque. Claiming he was the owner
of the company to which payment
was owing, Clarke convinced the
party to re-issue the cheque in his
name.
He cashed the cheque at the bank in
Goderich.
Clarke has no record.
Possession of stolen property
William Coates of Wingham pled
guilty to possession of stolen
property valued at under $5,000.
Morris said the Wingham police
were informed by OPP that during an
interrogation of Coates he disclosed
that he had taken a black medical bag
from a car in Wingham, Nov. 18.
The bag was returned.
Hunter suspended the passing of
sentence and placed Coates on 12
months probation.
Guilty plea
A Wingham man, who entered a
guilty plea to break, enter and theft
will be sentenced May 15.
A preliminary report and facts on
the case will be presented at that
court for Robert John Evens.
Obstruction
A man who obstructed police
during an arrest was given a
conditional discharge and 12 months
probation.
John Nolan of the Wingham Police
Services testified that on Sept. 7 as he
was attempting to take away one of
the people involved in a fight,
Andrew Reid of Wingham who pled
not guilty to the charge, “kept getting
in my way”. At one point, the officer
said, the accused tried to pull the
other man away.
Reid, Nolan said, “was very
intoxicated.”
The accused later showed up at the
station and after refusing to leave,
and opening the cruiser door, he was
arrested.
Reid said on that night he was
concerned for his friend and just
wanted to make sure he was all right.
At the police station, he was “waiting
for someone to come tell me where
my friend was.”
The friend, in this case, had been
put in a taxi by the officer and sent
home.
Reid told Hunter that “events
happened fast and my concerns were
for (my friend).
The judge responded, “I’m sure
they were but he was under arrest.
I’m certain you were quite
intoxicated and if you had minded
your own business you wouldn’t be
here today.”
Assault
Kenneth Foxton of Wingham pled
guilty to assault.
The complainant, a former
girlfriend told police that the accused
had turned up at her home, April 8.
He called her names, shoved her and
threw her across the room, said
Morris. Also, the Crown said Foxton
threatened to kill himself and said he
had a gun.
Duty Counsel John Myers said
Foxton does not have access to a gun
and called the incident at the lower
end of the spectrum with regards to
severity. He said it was out of
character for Foxton, and added that
the man has no intention of having
any further contact with the victim.
Foxton received a conditional
discharge and was placed on 12
months probation. He is prohibited
from owning weapons for five years.
Theft under $5,000
A Listowel woman, who pled
guilty to the theft of $114 must make
restitution within 90 days.
