Court news Man gets jail for breaching probation Failing to comply with a probation order has cost a Wingham man his weekends for awhile. Brent Webster pled guilty in provincial court, Wingham, March 20. Attorney for the Crown R. Guthrie told Judge R.G.E. Hunter that Webster had been convicted May 15, 2000 on charges of arson, break and enter and mischief. His jail term was followed by two years probation. He failed to report for an Oct. 5, 2001 appointment, nor has he been in contact with the probation officer at any time since then. Duty Counsel G. MacKinnon said the accused had been working at the time for a company which did jobs all over the province. Letters from the probation officer were not forwarded to him and Webster admits, counsel said, that he should have contacted them when he missed the appointment. Adding that Webster has been “a productive member of society since,” MacKinnon asked for a fine. Hunter, however, agreed with Guthrie that incarceration was required. He sentenced Webster to 45 days to be served on weekends. Assault Matthew Naim of Wingham pled guilty to an assault which occurred Sept. 8. According to Guthrie the victim, who lived with Naim at the time, had been out for . the evening with friends. She returned home earlier, but towards morning was downstairs when Nairn became angry, thinking she had just come in. Guthrie said the accused grabbed the victim’s head and shoved his thumb in her eye. Defense Counsel Mike Donnelly said his client admitted to grabbing her. The pair, who have two children, separated after the incident and there is no prospect of reconciliation, said Donnelly. After Nairn’s record was submitted, counsel went on to say that while his client had problems with the law up to the age of. 19 the most recent conviction was 1995. He asked Hunter to consider a suspended sentence. The judge fined Naim $600 and placed him on 12 months probation. Access to the children is to be arranged Tools stolen On March 4 at 11 a.m. a theft was reported from a shed located on Walton Road in Huron East. The victim told police that sometime overnight a shed was forced open on the property. Two drills, sander, hammer drill, circular saw and jig saw were stolen. These are valued at $1,400. Anyone with information is asked to call the Huron OPP or Crime Stoppers. through a third party. Marijuana possession A youth caught smoking marijuana on school property was fined $500. Federal Crown Donnelly said Luke Embling of Bluevale was in the principal’s office at F.E. Madill Secondary School in Wingham on Dec. 9 and “appeared to be under the influence.” He said the youth admitted to smoking marijuana at lunch but said it was not on school property. In his locker a small amount of the narcotic and a pipe were found during a search. Embling pied guilty in court. Marijuana possession I CERV Ontario I I I I I I MAKE A DIFFERENCE! Daniel E. Mullin of Blyth was arrested Nov. 29 after police stopped his pickup in Brussels during a routine RIDE check. A search uncovered a baggie with a small amount of marijuana. Mullin, who pled guilty, has no related record. He was fined $100. Assault Barry Allan Clarke of Mitchell pled guilty to assault. The victim and Clarke had been living together, said Guthrie, but had been discussion him moving out. Her injuries were minor. Fifteen years ago Clarke ' was convicted of assault causing bodily harm. MacKinnon said that when the accused had come home that night his eldest son said the victim had been having an affair with his best friend. The incident was “spurt of the moment.” Hunter suspended passing of sentence and placed Clarke on probation for one year during which he must receive counselling. He is prohibited from owning weapons for five years. Harassment Edward Clark of Wingham pled guilty to harassment. Guthrie said that on July 24, the victim reported to police that her ex-boyfriend had been following her around since they broke up in March. The Crown read a statement from defence council Lynn Johnston which said the accused thought the pair were going to continue to be friends and was having problems understanding the relationship was over. She noted that some of the encounters may have been accidental as Clark resided in the downtown area. Johnston said her client was receiving counselling to help him come to terms with the end of the relationship. As this was his first offence she asked for a period of probation. Hunter granted a conditional discharge and placed Clark on 12 months probation during which he is to have no contact with the victim and must receive counselling. He is prohibited from owning weapons for 10 years. Theft A Wingham man has one month to come up with the $7.50 it costs for a package of cigarettes. Edward Hickey was charged Sept. 7 after employees at a Wingham business saw him steal cigarettes from a car. He pled guilty to the charge. I I I I I
