Judge sends man to jail for 150 days A young Brussels-area man was sentenced to a total of 150 days in jail following a submission from his social worker in Wingham court Thursday. Though Crown Attorney Bob Morris recommended a 90-day sentence for Michael Walker, the social worker, who has been counselling him, asked Judge Garry Hunter to consider a longer period of incarceration to get the 19-year-old “healthy”. “This quite possibly could be the one thing that saves him,” she said. Walker, who pled guilty to two counts of assault, one of mischief and one of breaching probation was charged Nov. 24 after police were called to the home of his parents. Morris said Walker had become angry after discovering his mother had disposed of 18 gm of marijuana which she had found in his room. Walker told his mother that the drugs weren’t his and that he was now in danger. He threatened to shoot his parents, burn the house down and “dance on their graves,” Morris said. Walker punched his mother, then assault his father after he intervened. The mischief charge was over damage done to the garage door. Walker was on probation for an assault conviction from March 21. According to Duty Counsel John Myers, the social worker had determined Walker has attention deficit/ hyperactive disorder (ADHD). Myers also noted that no charges had been laid with regards to threats. Hunter pointed out the accused’s three prior convictions for assault. “Obviously there are difficulties here,” said Myers, adding that the social worker was hoping for court- ordered counselling. Hunter questioned the probation officer on her past dealings with Walker. She agreed that the accused had problems and believed that he was being helped by the social worker. Asked about Walker, the social worker said that the first time she met with him after these charges he was taking no responsibility for hitting his mother. “He said it was her fault because she didn’t put her hands up and that she was lucky he didn’t punch her in the nose as that was what he had intended,” she said. Noting Walker’s “horrendous” work-related history, as well as missed meetings with the probation officer, the social worker said it would be easier to ensure her client received the necessary counselling if he was in jail. Stating Walker was “obviously out of control at this point” Hunter sentenced him to • 60 days consecutive on each of the assaults, 30 consecutive on the mischief and 30 days concurrent on the breach. He was also placed on two years probation. Sentenced A Wroxeter man who was warned last month to get his affairs in order because he was going to jail was sentenced to six months. Paul Gerald Martin pled guilty in the December court to a charge of impaired driving. Hunter noted that Martin received a four-month sentence in 1996 for impaired and 90 days in 1986. Also he was convicted of drunk driving in 1985, plus has two or three convictions for driving while disqualified. Defense counsel stated that Martin had been dealing with his drinking problem and had gone through a lot of programs to help with his rehabilitation. Besides the sentence Martin has had his licence suspended for two years. Jailed A young Brussels man was sentenced to five months after pleading guilty to causing a public disturbance, uttering a death threat and possession of stolen property. Morris said that at 11:35 p.m. on June 7 an officer received a call for back-up at the Bluevale restaurant. A large gathering of young people were in the parking lot, many of them intoxicated, he stated. When Michael Cooper urinated on the side of a parked vehicle the officer told him to have some respect, said Morris. Cooper responded by shouting, screaming obscenities, calling the officer derogatory names and making lewd remarks about the policeman’s wife and daughter. Morris said Cooper then threatened to kill the officer. On June 22 a woman saw Cooper and another individual behind a vehicle which was parked at the arena. She later saw him walking off with a golf bag and set of clubs. When she called to him he dropped them and left. Morris said the owner of the bag later called police. Asked for the accused’s record, Morris noted a conviction for assault causing bodily harm from Sept. 20, 2001, and a conviction for failing to comply. Myers said Cooper indicated to him that he has a severe alcohol problem and admits when he’s drinking he doesn’t know what he’s doing. He was sentenced to one month for the public disturbance, two months consecutive for utter threat and two months consecutive for possession of stolen property. He is prohibited from owning weapons for five years and upon release from jail is on probation for 12 months. Utter threat Steven Hutchison pled guilty to charges of threatening death and of assault, dating back to Jan. 13, 2002. Morris said the victim, whom Hutchison had been dating, went to his apartment, upset after seeing him with another woman. Brandishing a steak knife he told the victim “I could kill you right now if I wanted too,” Morris stated. Hutchison later apologized and blamed it on “being high the night before.” Counsel for the accused said that her client has not had any contact with the victim since and has lived a “crime-free existence”. He was fined $1,000, $500 for each count and was placed on 12 months probation. Hunter gave him 90 days to pay the fine. As well, he must continue to have no contact with the victim. Over 80 Several drivers pled guilty to driving over the legal limit. Dennis Lowry, RR2, Wingham was charged Oct. 20. Morris said at 2:04 a.m. police stopped a pickup which they had been following. Upon speaking to the driver they noticed several signs that indicated Lowry had been drinking. Breathalizer readings were 190 and 180 mg of alcohol in 100 ml of blood. Lowry has no record. He was fined $850 and is off the road for one year. Hunter gave him 30 days to pay the fine. Jeffrey Olson of RR5, Wingham also entered a guilty plea on a drunk driving charge laid Nov. 22. Morris said the police had received a complaint from a motorist about a pick-up truck which was being driven all over the road. When stopped by police, Olson smelled of alcohol and showed signs of impairment. Breathalizer readings were 200 and 190 mg of alcohol in 100 ml of blood. He was given 90 days to pay the $850 fine. His licence was suspended for one year. David Haldenby of Kincardine who police arrested Nov. 22 also pled guilty to over 80. At 9:42 p.m. police noticed a pick­ up truck swerving towards the shoulder, then across the centre line. Morris said Haldenby fumbled while looking for his licence. There was an odour of alcohol and other signs of his having been drin­ king. Both breathalizer tests resulted in a reading of 130 mg of alcohol in 100 ml of blood. The 19-year-old was fined $850 and is off the road for a year. He was given six months to pay the fine. False pretences An RR3, Wingham man was fined a total of $500 after pleading guilty to two charges of false pretences. Between Jan. 29 and Jan. 30 James Norman had written two cheques totalling $1,800 for 72 round bales of hay. These were returned for non­ sufficient funds. From Feb. 19 to March 26, Norman issued three cheques totalling $4,736 for the purchase of 128 round bales. These too were returned. Defence Counsel Lynn Johnston said that restitution has been made. Norman was given 30 days to pay the fine. Conditional discharge An RR3, Wingham man pled guilty to causing a public disturbance by fighting. According to Morris, on Sept. 7, at 3:20 a.m. officers in Wingham saw a crowd gathering around a van, where two men were fighting. One, Mitch Braun of RR3, Wingham, upon realizing the police were present became co-operative, Morris said, while the other man did not. The 35-year-old Braun was given a conditional discharge and placed on 12- months probation. PERSONALS
